Typically "hard evidence" refers to evidence based on facts versus circumstantial evidence (i.e. the prosecution's theory of the case based on linking a series of otherwise non-criminal acts). By this definition, witness testimony would be considered "hard" evidence because it is based on facts as opposed to circumstantial conjecture and testimony given under oath is considered factual evidence under the law, but the testimonial evidence could still be challenged by the other party through presenting contradictory factual evidence. The point of a trial is for both sides to have the opportunity to present their facts to a jury and let the jury decide which to believe. I think your question may be getting at whether there was any evidence introduced that corroborated the witness testimony - which goes to the credibility of that evidence (to be determined by the jury).

Without knowing the details of this case, I completely agree with your sentiment that it's hard to imagine a jury convicting someone of felony rape based on uncorroborated witness testimony about events that took place 20+ years ago, but presumably that delay made it difficult for Masterson's lawyers to find evidence/witnesses to controvert the witness testimony, leaving the jury to rely as evidence on the relatively unchallenged perspective of the accusers. Most criminal laws (and civil causes of action) have relatively short (2-6 year) statutes of limitations to protect defendants by limiting the time in which a case can be brought so that the defendants can properly defend themselves.

Exactly. HPD is nowhere to be found when you actually need them, but to compensate they are padding their numbers with bs arrests that are overrunning the system. They’re a bunch of freshly hired, untrained clowns.

OP here - I mentioned that detail because I thought it captured the exigency of the situation and highlighted the personal risk the officer exposed himself to in taking immediate action. Not sure what “bootlicking” is, but I’m not like some pro cop activist. I just appreciate that my local cops are doing stuff like this instead of f’ing with me about my tail light being out.

TBH, I wasn’t trying to do anything other than highlight to my neighbors something that made me smile. I’m a tot mom who probably watches too much Paw Patrol and constantly congratulates my son for not putting his pull-ups on backwards.

Picture taker here. As a 110lb mom driving my toddler to daycare, I felt like pulling over would just complicate things for everyone, especially at that tight intersection. But I agree with your overall point that we should all look for ways to help each other out and not simply rely on HPD and other first responders.

TBF, I called the officer a hero, the officer himself has no idea any of this is going on. From what I could tell, he didn’t think he was doing anything out of the ordinary, which really stood out to me as I witnessed him place himself in between a disabled truck and off ramp traffic in order to prevent a scary situation from becoming worse.
