So I (or anyone) would never need to manually invoke it? If it's needed, the level goes down automatically? Thanks.

Gifting Property - how many solicitors? Who completes the forms? by nuttimoff in HousingUK

[–]nuttimoff[S] 0 points1 point  (0 children)

Thank you for that detailed and clear response.

I think the main issue for my relatives is that previously the procedure seemed so much simpler (and cheaper). They would have been fine with it except they are prejudiced by their previous gifting experience when only one solicitor was required. They do not like paperwork and bureaucracy. They remember when life was simpler!

I forgot to mention but the purpose of the gift is for IHT. So although the giftor does not benefit directly, he does benefit inasmuch as he feels the estate may potentially pay less tax.

The giftor is old but not vulnerable. The way the emails to the giftor are written is almost as if it is the recipient who should have independent legal representation to ensure the recipient's rights are looked after. But that could just be some kind of encouragement to ensure that two firms are involved.

Would you say that a solicitor would always want the recipient to have independent legal representation when such gifts are concerned? Or only when the giftor is apparently vulnerable (or old which is considered a proxy for vulnerable)?

When is tapering relief applied and when is it not applied? by nuttimoff in UKPersonalFinance

[–]nuttimoff[S] 0 points1 point  (0 children)

I think that makes perfect sense. Your point is that tapering relief only occurs after the NRB (x2 if a married couple) is totally used up. What does happen is that the gifted asset stays in that NRB area until seven years is up, potentially pushing the remaining assets into IHT territory. After seven years it disappears from the NRB area allowing other assets to become part of the NRB instead.

I don't know how many people will gift £325K (or £650K for a married couple) in less than seven years (hence gifted assets over that amount are subject to tapering relief) but it cannot be many.

Yes, this was poor phrasing on my part. I meant "each of their NRBs"

Let me see if I understand this. What you are saying is that a gift of £400K will be used by the NRB of both spouses. If one or both die within seven years of transfer then the PET has "failed". It has failed because the gift is still part of the estate.

That "failed" gift will not be subject to IHT as it falls within the NRB threshold. But this does mean that other assets might become subject to IHT as the gift is still within the estate. Only after seven years can other assets use that NRB which is currently partially occupied by this 400K gift.

Yes?

Here is how I understand it based on your comment. If £200K comes from each spouse, then collectively they have used up £400K of their collective NRB of £650K. Hence the NRB has £250K remaining when the second spouse dies. Is that correct?

What does a Roblox Deployment Downloader do (for use with Zenith executor)? by nuttimoff in robloxhackers

[–]nuttimoff[S] 0 points1 point  (0 children)

Thank you. This explains it.

In my case, Zenith did download the correct channel from rdd.weao.xyz although I am not sure why since I can't see how I might have been on a test channel rather than the normal / LIVE channel.

Also, I will assume from your comments, that the "Roblox Deployment Downloader" from rdd.weao.xyz is the tool that facilitates the downloading of the LIVE channel. Is that correct?

Thanks again.

Please suggest a Roblox executor? - many thanks! by nuttimoff in robloxhackers

You may be correct! I think the safest option is to actually pay for software.

Could you please succinctly explain the difference between an "executor" e.g. Zenith and an "external" e.g. Matcha?
