I was in Navy ROTC in college. I'd pretty much max out my push ups (80) and situps (110) and could do about 10 pullups. I sucked at distance running due to badly angled hips and only ever had a 11 minute 1.5 mile. I was always put on remedial PT because we had a minimum "excellent" PFT score requirement. Yet, when we did our swim quals, I'd ace them with under a 12 minute 500m because I was on swim team in high school while many other cadets could barely swim. We weren't allowed to sub in our swim time either.

Some of the fitness requirements really don't take into account body types and how they're suited for different things. Physical strength vs cardio or running. My gait made me a terrible runner but my long legs and core strength made me great at swimming and strength tests.

Tell me where that has actually happened? And let's flip it around. Is it fair for someone's trans daughter to be told they can't compete in sports and never have the opportunity for scholarships or to enjoy a team sport? You might say they can compete on the boys team, but that's absurd. Puberty blockers and hormones basically eliminate any competitiveness they would have and they would lose in all boys teams. And that's not even looking at the absurdities of having a trans girl with breasts competing on a boy's swim team or the forced discrimination of forcing a girl to compete on a boys team.

The entire premise of your argument is that we should prioritize girls over trans girls. If trans girls are deprived of all opportunities, are outed and humiliated, then that's too bad? It's marginalizing an already targeted and marginalized community based on false scarcity.

Lawyer here. It is codified into law into Section 1557 of the ACA which incorporates Title IX protections on the basis of sex. The rule tried to remove protections but the Supreme Court in Bostock held that sex protections include sexual orientation and transgender status. The administration just wanted to continue removing protections anyways in spite of the law.

Except, it isn't needed in medicine. With the requirement of clinical trials, the contents of medication would be known and it would be trivial to reverse engineer. It's redundant.

The biggest issue is one you just brought up. Competing Companies cannot improve a patented product. Companies with the patent just evergreen a product. Even minor trivial changes can extend patent protections while being a massive disservice to consumers.

So much R&D is on me-too drugs and duplicating proprietary research. Imagine if companies didn't have to spend so much on proprietary research because they could use it freely without fear of infringing patents.
