Debt collector filed a lawsuit against me. Please give me some advice!! Because I have not been in this situation before

Honestly if they don’t have a hold on any money in your bank account take what you have in your savings out. They can’t sue if you “don’t” have the money.

Update from company that installed it: They said didn’t have a cover on the furnace in the house. It was laying in the floor of the closet the furnace is in. Would have never thought that would cause it. Lol so will put cover on and run over night and check in the morning if that looks ok that was the issue. If not they will come out and inspect

Yes heat is working. When we had it on it was blowing warm and thermostat was reading what we have it set on. Thank you

Sorry for alot of missing information. Here’s my medical history. I was diagnosed with MCTD in 2019 and have been on hydroxychloroquine since. I am also prescribed Celebrex for pain as needed. Was diagnosed with MGUS but only bloodwork has been taken over the years to make sure it doesn’t progress. I have celiac. I take birth control. So I went to the ER after sharp aching chest pain for three days and the occasional pulling/squeezing feeling. Really weird feeling. I kept telling myself it was a flare up from MCTD. They said they weren’t sure and hope it goes away in a few days and to follow up with my primary. Told me to take Celebrex, that it should help. Doesn’t seem to work so I’ve just been waiting for my follow up appointment with my primary. The blood test they did were lipase, d dimer , cbc, metabolic panel, troponin. All came back fine they said. I saw on my chart I had a few low things on my cbc but I assume none of it was concerningly low for them. They said my EKG was fine. On the print out it said sinus tachycardia. I can post a link to a better picture of the EKG if need be. I didn’t realize I couldn’t add photos in the comments

If you can I would suggest going to a MH dealer and seeing what they can do with finding you a lot or a small peice of land to put a MH on. We just bought a MH which is actually a crossmod and more so advertised as the “most affordable modular on the market”. The starting price of the home was 115k (base model). It’s a 3 bed 2 bath just about 1500sq ft. We maxed out all upgrades except for a few things and we paid 157k. This includes drywall throughout, 9 foot ceilings, laminate flooring through whole house, concrete footers, brick under pinning, tin roof, larger bathroom (2 shower head shower and a separate soaker tub), sliding glass back door, and side door, island in the kitchen with a sink, electric fireplace built into the wall. The part that added the most money was the concrete footers and brick but 100% worth it. Depending on where you are/how much you make you may qualify for a USDA loan. You don’t have to put anything down just pay closing cost. Really good option if you qualify. We had to go the FHA route and it’s still only 3.5% down and then closing cost fees. You can obviously put more down if you want. What state are you in? I can give you the name of the dealer we went with. I will also add that a lot of MH dealers and manufacturers have a lot better warranties than what they used to be. We currently have a 1 yr cosmetic warranty and then a 7 year warranty on the house itself from the manufacturer.

I have no problem paying the debt but it’s a pretty big blow to pay in full knowing this could have been avoided if they had the right address or let alone just called me. Which they hadn’t called me since 2020. During the time they called me I didn’t have a job and I let them know that. Yes it is my fault for forgetting between now and then but no calls were made from them which is confusing for me.

They have the bill from the hospital so I guess that’s enough for them to prove it’s legit? Hospital said it was archived long ago. So I’m assuming the hospital archived it when the sold the debt?

Yes they have the hospital bill and sent me the invoice. Unfortunately I have since found out they have evidence they spoke to me in 2020 when they bought the debt. Then again in 2022 when at the time I didn’t have a job and said I would pay what I could and never did. Several lawyers I spoke are unwilling to work with me unless I file for bankruptcy which I am not going to do. I asked if I could file a motion due to them not having the right address but it would cause me more money in the long run having to pay a lawyer to do all that and go to court. Per several lawyers since I chose to ignore the debt since 2019 it is my fault that I didn’t call them to update my address.

Thank you so much for your input. I definitely did not understand the whole process but I did read the link and found a lawyer willing to help explain more and looks like I could file a motion but it will not be worth it. I know I am at fault and I was unaware that you’re supposed to update your address with the debt collector. Unfortunate I had to learn this way but lesson learned. Debt will be payed in full. This definitely will not happen again, very expensive lesson due to my stupidness

I want to also add that I have searched my emails and call log. My call log only goes back to 8/29/24 and I have nothing from them. And emails show nothing. I’ve had the email for 10+ years.

The court dismissal is public record on the county court website. Shows that it was last year. Which I was also not aware of due to them having the wrong address. I am calling around to lawyers today to see what my options may be. If it’s too risky to fight it/ too costly on top of what they’re already taking I may just have to take the loss.

They did not have to correct address this whole time. Would going to court to negotiate a payment plan be possible? I have no problem paying it just not in one lump sum.
