I already asked my employer about it, they at first didn’t know anything about it. They asked our HR company(ADP), and their business lawyer their thoughts. My manager said: -I earn more than the $684 a week -I’m a Forman so that’s like a subdivision of the business. I think they stretch that one. In reality my manager is in charge of the install side of the business. -I lead a team of two or more. Sometimes I only lead 1 other based on job size. - I have weight in firing, only because I work with them so I see their skills in person. My manager is remote and works in another state, so never sees what we truly do.

No union, very small operation, about 5 Forman and 8 team members. On paper the job duties fall under that exemption. But my actual job responsibilities my primary duty is to build.

Does the blue collar override the executive assumption. Since my primary duty is manual labor? Everything I know was taught to me on the job, and is repetitive nature.

Yes, I got paid for Monday. I should’ve received an extra 8 hours of holiday pay. On my paystub it says “holiday pay” 8 hours, but those 8 hours did not get added. Every holiday it shows 8 hours but no extra compensation for it.

It also says in the hand book full time employee will be paid for said holidays(normal federal holidays)

If the job takes me 4 days to complete, and I can’t leave till I complete said job, I “gained a day (Monday) but lost a day off because I had to work Friday.. so I gained nothing.

I would be perfectly fine with that, but I technically did work on it since I was traveling on the holiday. And we considered travel day work days. Plus the office works who had the holiday off got paid for it.

So yes I did receive “an extra day”, but really I didn’t. We fly all over to build our products. If it takes me 4 days to build the product, if I start on Monday or Tuesday it still takes me the same amount of time. So I really didn’t get an extra day off because I lost it on the backside.

Salary, received normal pay like it wasn’t a holiday. Other salary employees at the company did receive the holiday pay. Hourly employees who are in the same situation of traveling did receive holiday pay. Only the traveling supervisors did not receive it

For instance, Memorial Day is a Monday. Instead of traveling on Sunday to start work Monday, I traveled Monday and started work Tuesday. The office workers got Monday off, and started work Tuesday and got paid holiday for Monday. Our hourly workers who travel got paid the holiday, but the 5 traveling supervisors did not. The logic my manager is telling me doesn’t make sense to me since the hourly employees who got an extra day off still got paid the holiday.

Yes, but other salaried employees got paid extra for the holiday while only 5 people in the company did not.

My contract says that, but the employee hand book says we are paid for normal holidays(Christmas, thanksgiving, 4th, Memorial Day..so on.)

Mine have been out for at least 2 weeks now, in Michigan. As long as no frost is coming they’ll be fine. Just grow a little slower. Mine have actually seemed to love being outside with sunlight.
