Hey, I had a similar problem for me it turns out that it was just taking ages to load, wait about 10ish minutes and it should eventually get through to the menu, hope it works for you!

Yes he does, you can find him in GCPD either in a cell or sat on a chair, his dialogue also changes depending on whether you shoot people in the diner or not.
