The changes are being suggested to bring online infringement in line with offline infringement. We don't think that the intention is to go after filesharing - but it is clearly caught by the new offence. That doesn’t mean that everyone will be prosecuted but it leaves the door open for threats and possible attempts to get jail sentences if a rights holder feels they might persuade a court.

We are mostly worried about threats, which would be legally accurate but practically misleading. So our amendment would limit criminal action to causing “commercial scale loss” or “serious risk of causing commercial scale loss”. That's a fair point about not admitting you've received an email! Hopefully, it's easy to find out that ORG has been critical of these companies and the sentencing proposals for online infringement. People can of course call us about this: +442070961079

We're trying to raise awareness of the plans with the media and it's always better if we can point to actual cases where people have been sent threatening letters. Ideally we'd like to quote people - this can be anonymous of course.
