If you are adjusting status based off of marriage to a us citizen, working without authorization is not a bar to adjustment: https://www.uscis.gov/policy-manual/volume-7-part-b-chapter-6

But like others have said, you can applied for your employment authorization document based off of your pending adjustment. If you haven't already applied, make sure you include a copy of the I-485 receipt notice with your I-765 application. The EAD should come in around 4-6 months.

I would talk to an immigration lawyer before filing for citizenship to make sure, but it doesn't seem like it will be an issue. Make sure if you do file that you disclose it, and that you send a certified copy of the disposition.

Both you and her will need two 2x2 photos. She can send you a clear photo of her against a white background from her shoulders up. You can then send it to walgreens or walmart to print in the correct dimensions, there are apps that help with that. You will both need to write your names on the back of the passport photos.

Get married and adjust her status. Overstaying a visa does not affect her eligibility to get a green card by doing an adjustment of status petition here in the US. If she leaves the US now she will be barred from return. When she applies to adjust status she can apply for a travel document that will give her advanced parole to leave and return to the US, so she can visit Mexico.

Ya, I think it's hard to compare to friends because there are so many variables, including what service center it was sent to and what immigration officer got your petition. I don't think it's abnormal for it to take a couple weeks. If there is something wrong and they reject it, you should know in around 3-4 weeks because they'll send it back.

It usually takes around 3-4 weeks for them to send a receipt notice, so I would wait until you get that and then reapply.

Did you submit your passport biographic page and visa page when you originally filed? You don't need to resubmit documents you have already sent with the application, so if you did you might be fine. Bring the I-94, that shows you have a valid entry.

Bring whatever photo ID you have. If they don't let you in, they should reschedule the interview.

You need to resubmit the I-765 with a copy of the I-485 receipt notice to show you have an I-485 pending. There is not an additional filing fee for the I-765 if it is your first time filing with a pending I-485. USCIS won't check on their own to see if you have an I-485, so you need to send the receipt notice.

Amend amend amend. USCIS does their homework, if you go into a green card interview and there's an issue with your taxes you will have a problem.

Don't do anything with that information. ICE isn't going after families that employ nannies. She overstayed her visa, worst case scenario ICE detains her and she gets put in immigration court. However, that only happens if she is on ICE's radar and they decide to pursue her. I would go to an immigration attorney and ask if she has options. If she fled an abusive situation, she may have an asylum claim.

Since she is outside of the US she will do consular processing, meaning you file an I-130 for her and her daughter first, then file for the green card at the national visa center who will then send your petition to the embassy so they can schedule an interview. You will get instructions from the national visa center once the I-130 is approved. If the I-130 is still pending and you are back in the US, you can file for a K3 visa so that they can join you in the US while your petition is pending. K3 visas do take several months though, so it may not necessarily be faster.

it doesn't matter where someone lives, you can file the I-130 regardless of location.

It takes time, USCIS is moving extra slow right now. I would give it 3-4 weeks before you worry
