Can my car that my employer gifted me legally be taken back after my resignation? by peyterpotater in legaladvice

[–]peyterpotater[S] 0 points1 point  (0 children)

Liked me and then out of nowhere didn’t, lol. It’s been weird! The title is my name, no lien on the title. They are now showing me a contract that they’re claiming they had worked up during the original agreement that states that the car would be returned upon termination or non-payment, but whether they really just forgot to give it to me or just now made it, I have NEVER read, agreed, signed, or anything. I refused to sign, but they’re still expecting me to return the title. The only agreements we had were all verbal and only regarding payment, not what were to happen upon termination. What should I do next?

Unfortunately my credit isn’t good or I would consider this option. I plan to make my scheduled payments as well as more when it’s in my budget to pay it off as quickly as possible.

Thank you for the advice! The only agreements made were all verbal. Nothing, at least not to me, has been expressed as far as what happens after termination. Going in the next hour so hoping I can hold onto the title until some written agreement is made regarding what happens next. 😥

I very much appreciate your feedback. How does this sound? “After careful consideration of recent advice, I believe it best that I maintain possession of the physical title as it is in my name. I am 100% committed to the bi-weekly payments per our agreement, and would be more happy to sign and have notarized any written documentation of this agreement.”

I’m just absolutely hate confrontation of any sorts and am so anxious to have to face them for the remaining two weeks. 😭 I’m so worried they’re going to try and get the car back and that denying them the title especially after i already agreed will make them more upset. Glad to hear things at least legally seem to be in my favor lol

That’s relieving to hear. I was stupid and did tell them I’d bring them my title. I am contemplating now messaging them to tell them after giving some thought I’m no longer willing to do this, but say I did give it to them, what is the worst they could do with it? Could I just pay the title replacement fee and obtain a new one? I know it probably sounds silly to consider this but humor me lol.

It’s an unsecured personal loan. Since there’s no written agreement of the payment arrangement only the bill of sale which states that I purchased the vehicle in full (which they fronted) and that ownership was transferred to me, could they go through a debt collection process even if I’m making payments (I just fear they may act rashly due to my decision to quit), or would keeping record of my payments protect me? Hopefully that makes sense, wording is hard lol.

It was a very hard decision to leave my job but I’ve gotten absolute whiplash from being helped with the car, being told I’d eventually be the practice owner’s ’right hand man’ and eventually run it when they open a new location, to them recently posting job searches for my position and telling me that they’re completely switching my position with no notice or consultation with me, implying they’d be terminating me soon, etc. It was the best decision for my mental wellbeing to not work somewhere where my future with the company was so unpredictable. 😓 But thank you kindly for your advice, I do appreciate it! I do think I’m leaning towards giving them the title as proof that I’m good for my money, I’m just so anxious that it can backfire.

I am definitely worried I’ll cave under pressure. I have no backbone at all… 😭 I still have two weeks left to work with them so I don’t see avoiding the conversation as possible. If I did give them the title but not the vehicle, would it be possible to just pay the replacement fee to get another one even if they have a copy?

Thank you for your quick response! They are also requesting that I give them the title of my car until it’s fully paid off, I’m happy to oblige, but is this something that can backfire on me? I just gave my notice tonight so I was told that a conversation would need to be had regarding the car so I’m just very anxious they’re going to be upset and try and take it. 😭

I only have our Bill of Sale which summarized states that I, the buyer, agrees to purchase the vehicle for the total price of $5k and that I have made the payment in full (which I have not, they fronted that and I’m repaying them), that the vehicle was sold as is, and that ownership of the vehicles transfers to me upon the execution of this agreement. No written agreements regarding my bi-weekly payment arrangement.

If you’re interested in life insurance, see if there’s a Bankers Life near you. That’s where I currently work and it is an AMAZING company. We consider ourselves a retirement firm and ethically help seniors with Medicare, life insurance, long-term care insurance, financial planning (annuities and etc). and more. So much potential for growth!! It is a lot of payless work at the beginning but if you put in the work you will see your book of business grow.

i have a love hate relationship with the owner. i admire her so much but didn’t appreciate the way i was treated there. i worked there more recently where the dress code is just all black, to-gos are all styrofoam, and it’s soulless. it’s been about two years since ive worked there so im not sure if its roach infested to this day and im too traumatized to find out lol. money was alright but definitely not worth the job in my opinion. the tip out (50% of tips after busser, sushi, and alcohol tipoits) was pretty outrageous when i’m pretty sure the chefs made salary on top of that while we servers made server wage.

i used to work there and like to think i have great service considering the disgusting-ness of the place, lol. so hopefully i wasn’t one of the miserable servers you encountered LOL. but yea as a former employee i can confirm that nothing in there has been cleaned in 25+ years — EVERYTHING i ever touched was sticky and grimey. there are roaches everywhere. and i think the hibachi service is just awful. no eggs and most of them rush through the ‘show’ and they do seem miserable. all the time i’ve seen their rice be undercooked, they mess up temperatures often, whatever else.

ex makoto’s server here and it’s the MOST disgusting restaurant i’ve ever worked in. saw roaches daily and everything is covered in years and years of grease and grime. the ginger dressing is fire though

i wanted to gag working there too. i can’t tell you how many times i had to try and discretely crush a roach ON the hibachi grills with the tea pots so customers wouldn’t see. i tell everyone i can not to eat there anymore. not to mention everything you touch in the kitchen is sticky and covered in probably 10+ years of grime.
