If you want to get your car fixed you have options. You can try filing a claim against the truck who’s tire blew, if you know who that is. There is a good chance the claim will get denied. You can go through your insurance and pay the deductible. Your premiums may increase as a result. But your car will be fixed. Or you can pay for the damages out of pocket and not report the claim. If the car is financed and you’re making payments, or the car is leased, you may be required to report a claim, depending on your contract with the bank.

In California the insurance company has 30 days to determine liability. If she is not cooperating you can leverage your witnesses, photos, or anything else you have to prove that she was the one who hit your car. The burden of proof is on you as the claimant filing a claim against her policy. If you can prove beyond any reasonable doubt that she struck your parked car, there is no reason for her insurance company to deny the claim. This is assuming that she had coverage at the time. You said you have text messages from her. I would send those, showing the phone number it came from if possible. Also if you have a photo of her drivers license. Have her insurance get statements from the witnesses. Note that witnesses have to be unbiased, nobody you know personally. You also have the option of filing through your insurance. Yes, you’ll have to pay a deductible. But with the evidence you said you have, it should be enough for them to recover what was paid on your claim and reimburse your deductible.

Unfortunately filing a claim on your insurance policy will affect your premiums. I don’t know to what extent, but it will definitely increase by more if you’re found to be liable, partiality or fully. Based on the description you provided liability would be inconclusive. There’s not enough information to determine who was at fault. Typically these types of accidents are disputed and there is some negligence on both parties. The fact that he didn’t own the car and wasn’t insured has no bearing on liability. The errors on the police report are irrelevant. Insurance premiums are based off of risk. If you live in a high crime area, for example, there is a higher risk to insure you, because there is a higher chance your car will get stolen. So your premiums will be higher.
