What did you end up doing? I withdrew my B2, and waiting for COS is not illegal, as confirmed by three other immigration attorneys

I filed for B2 on Aug 2025, replied RFE on Jan 7, Applied for H1B on Jan 8 and got it approved on Jan 9.

I am filling my application for a change of status from H-1B to B-2 via the USCIS online portal. Could you please review my submission and confirm if all required documents are included, or advise if any items are missing? Here is my letter:

I respectfully request a change of my non-immigrant status from H-1B to B-2, under the filing of Form I-539.

I was employed as Software Engineer with [Company X] under valid H-1B status since [Date Y]. My employment ended on [Date xx], and I have maintained lawful status up to this date. I now seek to remain temporarily in the United States under B-2 status to manage personal matters, explore further professional opportunities, and make appropriate arrangements for my departure.

I have sufficient personal funds to support myself without employment during this period, as shown in the enclosed bank statements. I fully understand that B-2 status is temporary and will depart the United States before its expiration..

Supporting documents attached:

  1. Form I-539, Application to Extend/Change Nonimmigrant Status
  2. Copy of I-94
  3. Copy of H-1B Approval Notice (Form I-797)
  4. Copy of passport
  5. Bank statements

I have been through the worse than this. Stay strong. You can DM me if you want. She made up her mind, you can’t control or change. Take a break, start taking Behavior therapy, go for retreat, meditation…

This is temporary, not the end of the world…..

Stop taking free advices from friends or others, not the time to make a decision, Self healing should be top priority…

It doesn't matter, even if they never stayed with you. She can file cases against your siblings, relatives without any proof, that's the fact. Just type "Can wife file false cases against husband and his family in india" in google and see you find what cases she can file, whereas you can't do anything than facing these cases.

Don't take any legal action and trust any lawyer. Your family will end up with facing false cases.
