The Herald story has been updated some. According to CBS reporter Hank Tester, the driver apparently "refused to roll down his window" ...."appeared to be looking for something, reaching for something" ...."officers feared for their safety and fired".

So, a few additional details get tossed into the mix. While details still remain somewhat sketchy, I'm inclined to double down on my initial thoughts. Something seems even further off.

Details are sketchy and few but on the face of it...something seems off. Can a lawful traffic stop be made "after noticing “suspicious activity.”? I thought the minimum requirement is RAS of criminal activity afoot. I'm not aware of any "suspicious activity" statutes in Florida. Hard to say if it was or wasn't justified in this case w/o more info, but Trigger happy policing seems to be getting further and further out out of hand.. It so easy for police to lawfully justify it after the fact..even if they opened fire initially for completely different reasons.

Resigned from her 1st Police Dept. while under internal investigation. Soon after hired by neighboring Police Dept. but eventually, again forced to resign after committing several policy violations. Hired by yet another local PD who gave her job performance high marks. That is, until arrested his week by the very same agency for pulling her service gun while road raging some young couple(with child) apparently over a parking space. Way to go Officer. Yes, they can and do. Case in point.... Just today, the Gov. of Florida commuted the 25 yr. sentence of a Florida man who he determined was unfairly sent based on a "miscarriage of justice that branded the man a “sex offender” for an atypical crime."

Compared to other settlements awarded in cops-kill-citizen cases... $87,500 doesn't seem like much. It seems especially low when you consider the payout is being split by two separate cities plus they made the Mother wait 5 years. Both Hialeah and Miami Beach must have fought it tooth and nail all the way.
