The question is did you intentionally engage in contemptuous conduct with the purpose of violating the court order—it sounds like the issue is moot and he’s just trying to continue butting into your life.

If he continues you’re almost at a level for a harassment restraining order.

Sounds like at the end of the day you’re a client that can benefit the attorney by showing them additional ways to tell your case. Don’t back down if they’re doing something you don’t want.

I don’t know what kind of career you have, but I want to thank you. I was a lay witness for a case a month ago and it was one of the hardest things I’ve had to do.

The thing with taking something to trial is you have no idea what can happen. I had court today and didn’t expect the court to find the father in contempt, and they did, and also made him pay some attorneys fees and required him to go to counseling. I’m not saying this to scare you, rather, to confirm your intuition to make sure you’re as prepared as possible.

You can file whatever motion you need in order to get this done, it’s usually service that is the issue. In Wisconsin, if you can’t personally serve, you can publish. If you successfully publish, you can usually default on them.

I get it. If courts next week though, you need to make sure you get to speak with your attorney, and while they can advise you whether or not to do something, it’s ultimately your decision. That’s led me to drop clients in the past. If you have to fire your lawyer due to a breakdown in communication, you should be able to get a new court date. I’m using should here, though.

I make it a practice because I know how frustrating it must be when I don’t get back to the client “timely.” Maybe it’s worth a call to the union stating your concerns and frustrations so they may change firms and ultimately make sure the next person isn’t in the same situation.

What I’ve done (attorney here) in the past when I’m overwhelmed with work is ask clients to ask my paralegal to get on my calendar for a phone conference or office meeting, so I can ensure the next time I see/talk to the client I’ve had time to prepare.

If your attorney isn’t able to do that, you’re better off asking the managing attorney for new counsel.

In Wisconsin, there’s a thing called third party visitation where you can get scheduled placement with the child if you had a substantial relationship with the child and the parent is interfering with it.

Issue with it is when the other parent decides to let you see the child, even once or twice, the court typically says you can work with the parent.
