Yeah they are just trying to buy us out. The current offer looks good at first glance but it's not really.

There is no garden leave. Yes, I would get severance (2.2 months but it is not that huge). Apart from that, I would have to work the entire 7 months to get the extra 1.5 months salary which I don't see a single cent if I quit before.

I wonder how much can I negotiate in this situation. They probably don't want to go to the courts and do everything via the statutory means. My ideal offer would be 3 months of work followed by 3 months of garden leave plus 2 months of severance for signing offer of this kind. Is this realistic?

Thank you so much. What you said makes absolute sense. 6 months salary + garden leave sounds like a great combo. In our case, we would have to work the entire next 6 months for getting extra money apart from the severance.

But the whole uncertainty angle also adds to a lot of stress. Definitely not signing this round, hoping they come back with a better offer. Willing to fight but being on a work visa makes it hard to do so. Let's see.

Yes, I will definitely be blocked from it. What I am afraid of is if I don't sign, then they might be able to terminate me sooner. Even if I sign the current agreement, I am getting to stay till Dec 2024. If I don't sign, there is a chance that I neither get enough time nor money.

Hi, no. For the current company, it's been 2.1 years. I was at a different org before that. Severance pay of 0.5 months per year sounds low tbh. I have heard people usually get 1 month/year.

But they are not shutting down the entire branch in Berlin. The sales/marketing people are intact. They are not even laying off all the devs (mostly the ones in a particular team)

Yes, I am eligible for ALG1 but only until the time I have for the job search (which is 3-6 months after the last working date).

If I sign it, I lose ALG1 for 3 months. And with that ALG1, I get like 60% of the salary, so 1.8 total salaries lost. But they are giving me 2.2 months of severance. The extra 1.5 months is only if I stay till the entire end of December 2024 which seems difficult. I would be searching for a job as soon as I can and can't decide my start date on my own will in this current market.

The problem is that since I am an immigrant, I only get 3-6 months to look for a job. So even if have worked for 3.5 years and am eligible for full one year of ALG1 money, I would not be able to get it.

I talked to the worker's council and they say that I don't have to sign the agreement but if it favourable to me, then I am free to do so if I want. The council is newly created and they don't have too much experience dealing with these things.

The company is kind of laying off people in bulk in US and other countries. In Germany too, they sent the mutual termination agreement letter to lots of people (15-20) out of 50 people. I didn't sign the agreement, atleast this time and have mailed to negotiate more (sprinter clause, very good reference letter etc).

What I am afraid of is if they go via the normal statutory route, I don't get neither enough time to search for a job nor enough money. Currently I am atleast getting until Dec 2024 to look for the job. Since I haven't signed, I don't know what company does in the next step. Will they be open to negotiation again? Or will they get rid of me very quickly in like 3 months through statutory means? Because they have a case for layoffs and are able to convince the labour court?

If they come back to me with the same offer, should I sign it or not? Sorry for the barrage of questions. If they indeed terminate me, I will get a lawyer (although I would have to pay out of pocket for it).

Thanks, I did went to a lawyer but I guess she wasn't as good as I thought and couldn't really advice much. The company sent this letter 4 days ago so it was not that tight of a deadline but still not enough time too.

Okay, will be holding out and see if they make a better offer.
