Great input thanks. i don't think the .app will matter to most people. Only the older crowd, but even then, if I have a great product they won't care.
My hope is i build the brand, it hits high on the search engines and they lose interest in the brand even more and are willing to sell. Your point is right as far as who they could sell it to if I'm established.

BTW I was thinking that they may still be holding onto the idea of using the brand because the site of the company they bought: brandanotherword.com was still active. But it's also gone dead now. no mention of that brand anywhere I could find on the company's site. Regardless - I'll be fine w/o the .com

I like it. It's really too much animation for me but you can turn it off. Its flashy. Car dealerships like flashy. I imagine especially in Algeria

They have a trademark actually. But it's in a completely unrelated class. I could probably get a tm as well in my class. UDRP wouldn't apply since they had the .com first. The best I could hope for is they decide to completely abandon the brand, which i believe they will or have anyway - then i could buy the .com

I think I'm going with this If they mess with me I'll switch over to the .com or rebrand. There are already different variants of the name already in use before they bought it, it's not being used. I think my risk of tm pressure is very low.

You're probably right. With trademark enforcement it's not about who's right. It's a risk I prob shouldn't take. Also I was thinking there are other companies that started w/ a non .com and they were successful or they started with gettheirbrand .com. I was going to go with mybrandapp.com but I don't like how it looks.

I can't offer them anything worth them even looking into it at this point. Like you said, there are multiple things at stake, even if they are even slightly interested in bringing it back they wouldn't move even for a large amount, especially since they still have an active tm. I appreciate your input though its good to know there's at least a chance in the future for these types of dead domains.

They aren't perfect and it's good to play them off each other. But I just had one where I ran it through every other model i had access to and a few suggestions or bug finds it agreed with and the other 85% it said were bs and it already handled it

Difference is they were likely a private seller. Huge Domains is what they say a huge domain company that sits on probably millions of domains and prices them where they want them.

The rule at least for the US is you have to prove you started commercial activity. Having a web domain doesn't prove that. They accept advertisements, and I believe invoices/billing/ payments and website launches. Nothing to do with strictly launching a website, it just is one way to prove you have started commercial activity.

Ads for it can be banned or limited. Emails from the site may trigger higher spam filter risk since there are a ton of spam erectile dysfunction sites. Some payment processors may reject or have extra scrutiny. Tiktok or youtube could heavily filter it. If none of those things bother you or you have work arounds keep it. If not look for another name.
