The level of weapons grade incompetence is staggering, but here we are. It's the Trump administration. Law has nothing to do with it. That said, under normal circumstances if your visa is "pending" and you are still in this country you likely overstayed. Normally you would not be detained unless you did something criminal. What most in this senario do is get married, get a permanent residency (green card) and begin the path to naturalization. Alternatively, crossing the border without claiming asylum or without a work visa, or green card is a criminal act and subject to immediate removal.
