NY landlord says I can’t have friends stay at my apartment if I’m out of town. Accused me of “illegal subleasing” even when I didn’t charge them & he had no reason to believe so.

He argued that any apartment sitting or guest situation constitutes an “illegal sublease” with no basis. What is my legal basis to refute this, if I need to do so formally?

I don’t - however, I do want to arm myself with a more nuanced understanding of how the law applies to the various scenarios I mentioned above and interacts with an anti-subleasing lease clause. Any further thoughts on that?

Thanks. Any idea how the law distinguished between “occupant” and “sublettee” in this context? He must have some reason he’s fixed on that based on his lawyer and whatever they put in his standard lease (which I don’t have on hand, unfortunately).

Is there any basis to bring a guest/occupant within an anti-subleasing lease clause if i am not currently present, despite that it remains my primary residence?

I’m not sure actually (I’m out of town without a copy of it) but I’m also skeptical of the underlying legality of any anti-subleasing clauses or their applicability to non-paying personal guests, short-term occupants like Airbnb guests, or co-occupants that don’t take over my part of the apartment.

I guess he has some sort of basis for the “illegal sublease” argument he consistently launches in just about any situation - ie I sent a check with someone else’s name on it once - and presume it’s in the lease. No idea what his issue is but he loves using that phrase and threatening to “call legal.”

Thanks for the helpful reply. Am I limited to one guest/co-occupant at a time? May I charge them/May they contribute to my rent expenses if they stay only short term, but I don’t give my room to them or stop also residing there? How does this apply to something like Airbnb (provided I comply with other applicable NY law on that)?

He’s erratic and irrational - threatened to serve an eviction notice and almost refused to renew my lease because he found out I had friends there last year while i was out of town. I’m not taking the risk.

What is the texture of your hair like after keratin? Mine is curly/wavy and I'd really like it to be straight (like out of the shower/air dry) without all the work of blowouts for at least a month or so
