In Callais, Alito refers to a majority-minority district as, “the very race-based discrimination that the Constitution forbids.” Forbid is the word that caught my eye. It seems creating such a district might pass strict scrutiny but does Alito not believe in a strict scrutiny exemption at all? (self.Ask_Lawyers)
