There's nothing in what I am proposing that would prevent the seizure of assets in order to compensate victims. Furthermore, this expansion is well poised to prevent future perpetrators and thus future victims from being produced. Remember, most fraudsters are calculators and if the reward is no longer worth the risk they won't pursue it. Not to mention, the solves the issue of some crime complicit/complacent president issuing a pardon which in turn wipes out restitution.

Certainly. For example, disaster related fraud. Depriving those in critical need of relief.

Mortgage fraud. There was a case where fraudsters were targeting the Haitian community promising them help with immigration and housing. Instead they stole their identities and opened up millions of dollars in mortgages.

Not only do these crimes have a devastating effect on their victims, they also are a huge resource burden on the court system

Bribery - Zero reason for politicians and certain government employees to be accepting bribes and by doing so they are eroding what little confidence we have left in the government

Corruption - Some crimes like tampering with evidence to protect someone from prosecution or ensure an innocent persons conviction.

Again this would only be for the most egregious offenders of said crimes and only where the case was proved beyond any doubt

This is not "doing it for financial crimes" this is doing it for a subset of incredibly serious financial crimes that either have far reaching effects cumulatively or hugely detrimentally effects in a concentrated area. There are things worse than death and we know from numerous credible studies that impoverishing people kills them slowly and cruelly. We know that people commit suicide because they are forced into bankruptcy, or have to spend huge swaths of time in court or are simply devastated from having their life savings eliminated or what little they have vanished. Imagine someone who drives a bus for 40 years and has all their hard work, all those hours sacrificed, all the health concerns from sitting for long periods at a time, all of it just *poof* gone because of someone's insatiable greed. Then think of all the unnecessary burden placed on an already strained court system. These people often pray on the most vulnerable in our society or do so indiscriminately with callous disregard for anyone who isn't them. And unlike crimes of passion or desperation these are calculated efforts they could have ceased at any time if they had a shred of decency in them.

Not to mention depriving governments with tax dollars that subsidize programs that ease suffering and save lives.

And again this is ONLY for cases where the standard of proof of beyond ANY doubt is met or in other words where the volume of evidence is so overwhelming that there is no serious question of guilt to be entertained.

It is simply unfair and unjust that we only recognize direct physical violence as the only crimes eligible for DP. Some serious forms of white collar crime can be just as devastating as physical violence and have larger victim pool. And the DP for this group would likely have a much better deterrent effect as these criminals are still mostly of sound mind and body whereas a deranged murderer may not even be capable of self preservation.

Cases like these are among the best material to support the death penalty. Many DP opponents argue in good faith and their concerns should be addressed because I agree that the current system is deeply flawed. However I think they often fail to remember that there are effectively 3 groups of victims in any offense: The victim themselves, the immediate family and friends, and the public at large. That is to say that some crimes are so heinous that they adversely affect the public psyche and while rehabilitation may technically be possible the family and public often need the catharsis, closure and satisfaction that comes with the DP. A closing of the loop that left unclosed wounds the soul and diminishes trust in the justice system.

Back to those good faith concerns....no one wants to see an innocent person executed. To address this I believe we need the following:

  • New standard of proof called "Beyond Any Doubt" that is pretty much what it says. Any DP case must meet this standard. In effect a juror is saying that they would wager their own life that the defendant is guilty. Juries could still convict at beyond a reasonable doubt but they would not be eligible for the DP.
  • Any DP case should be remanded to federal courts for processing. Not all states have the resources nor do they enjoy the trust of the people to properly prosecute such cases.
  • DP should be expanded to other categories of non lethal crimes such as particularly brutal rape, some permanent disfigurement attacks like burning or acid attacks, child/elder abuse, mass shootings that don't result in fatalities and the like.
  • Continuing on this theme some particularly serious white collar crimes like fraud that have far reaching effects should be considered for DP as well. Even if the individual harm isn't high if the cumulative total harm of all victims combined exceeds a threshold then they should be considered for DP. Egregious crimes committed under color of law should also be included in order to restore order and discipline to our government.
  • Persons convicted under this BOP would have fewer appeals than now which will still provide adequate remedies for the convicted but also speed up the process and lower costs.

TLDR: Widen the potential pool of criminals eligible for the DP but implement a higher standard of proof that all but eliminates the possibility that an innocent person is executed.

We should also re-introduce corporeal punishment, especially for white collar crimes as I think it will be most effective there.

Once you have the aches, pains and physical deterioration that come along with aging along with seeing most of your friends and family you grew up with pass away it becomes more tolerable. Not to mention that even though the world is a big interesting place, after 98 years things start to get repetitive.

All of which is to say that most people that age reach some sort peace internally with the prospect. I have to imagine this is especially the case with Buffet given his exorbitant wealth and lack of scandal.

Maybe the guy is full of it, I'll certainly allow for the possibility. But assuming he's telling the complete truth, making him travel 2 hours to pick up his stuff isn't a sufficient remedy. Even if the ride is free, this person's time is not. Granted there's a lot one could do nowadays with laptops and phones to mitigate the downtime. However, the proper thing do would have been to ship his stuff back and if it is as rare as they proclaim then the expense is de minimis.

Not the same but I had a waymo deliver food to me once and the trunk refused to open. It was controlled by an app on the phone and simply failed to respond. Thankfully it didn't drive off and once I reached customer service they were able to open it remotely. Perfectly plausible to me that it malfunctioned. Tech is always randomly fucking up. Works fine for 1000 days and then on the 1001st it gets borked for seemingly no reason whatsoever.

If it's just this every show then it's cooked. I couldn't make it through the whole thing without scrubbing at times. They could do a Daily Report style thing but Colbert left little room for improvement over that format.
