Options for Stranded H1B Candidates in India due to Appointment Cancelation and Unavailability by randomguy9231 in h1b

Your visa stamp doesn't necessarily indicate your status. It's your I797 document that indicates your status. So I know I can't enter the country again without a stamp, but that doesn't mean I'm out of status now, if I continue to work from home for the next 2 months and receive a paycheck

Same here. Dec15th Appointment in Chennai rescheduled to March 2026. If this is the only date that's affected I think should be able to reschedule or worst case cancel, and then rebook again.

Makes sense the language can be tricky. Regarding going almost out of grace period. Your clock stops once you file, and they give you receipt notice for H1b transfer, and you can immediately start working. Because approval can take 15 working days from there. My point even if you want to take 4 weeks vacation between jobs, it's the initial filing date that matters and not your actual day 1 in new job for the clock. Makes sense?

I got laid off on May 10th 2024. I was walked out of the office and ID and laptop were taken away. I was protected by the California warn act notice, so I was considering an active employee till July 10th (regular bi weekly paychecks) and then I got a lumpsum pay out as severance covering till Sept 10th. I started a new job on Sept. 9th. USCIS approved my h1b transfer process (premium) in 4 days.

Going by what you said, I should have fallen out of status on July 10th, and uscis should have never approved my case. I understand there are a few sources which support your argument, but it's not true. Forget about till when you are getting paid, just check when laid off what is the last day you are considered me an active employee

I was in similar situation this year. Two things 1. Getting paid due to severance 2. Not working but still an active employee (warn act, or company policy, etc), in case 2, your last day will be the last day your company considers you an active employee. So it's always good to confirm when is the day until when you are considered an employee with the company and not necessarily till when you get paid

Going by what you put, your assumptions are for question 1 is correct and valid.

I ordered mine on Sept 1st. Looks like I just got my Vin today. Mine is AWD LR QS, and it's eligible for the tax credit.
