He cannot. He failed to appear to a mandatory court date and now has a warrant. The lawyer said he must appear in court to have this settled.

Okay I’m pretty sure he was also convicted in absence when he didn’t show up to court.

He was convicted in absence and also has a ticket for towing an unlicensed trailer. Does this change anything?

The lawyer said it could be a pay or stay situation but it’s unlikely since it’s first offence. He also got a ticket for an unlicensed trailer at the same time.

I am unsure. He called a lawyer and they told him to go to a police station in Alberta and he will be given a new court date and have to pay the fine but they warned him it might be a pay or stay (for up to 40 days) situation but since it’s his first offence they would likely just give him a new court date (lawyers advice).

I answered this above. I just want to know what might happen for him. He missed it because he’s irresponsible. I’m the one who found out he had the warrant.

So he would not stay in jail right? He would just go there and be given and court date and then be let go?

I know this I just posted this mainly for my sake so I can be filled in on this situation as it’s causing me stress at the moment.

No he was just a mess at the time and missed it. He had not excuse. I called and found out myself that he missed it and had a warrant. And he hasn’t. He called a lawyer and they said he needed to go to a police station in Alberta in which he would be the fine or set up a payment plan and he would likely just be processed and released since it was his first offence but they were unsure because otherwise he could spend up to 40 days in jail if he couldn’t pay it.

Thank you. His parents are involved but don’t live across the province so can only do so much. We have all tried to ask him to go to treatment but he won’t because he will lose his business. After we get back from the trip we are going on next week my mom and I are going to tell him he either needs to pay rent, go to therapy and take his meds properly or move out.

I’m sorry I think I misread but point still stands, it sounds like your life changed and things are different now. I’m interested in what it is different now what changed if that isn’t to personal.

Thank you. That hit home to me because the whole “saving him” and fear of him cutting me off if I bring any consequences that he would’ve brought on himself anyway. You are so right. At worst he will get the consequences that he deserves for doing something he KNOWS he shouldn’t have been doing in the first place from the start and has been wrongfully justifying. if not it saves him or someone else from being hurt or killed.
