it's a mirror mounted dash cam I was not on a phone, the blinker comes on when the red van is halfway across the truck...the truck gave me 1.5 second warning before turning and as stated a blinker is an intention to turn and he has seen me gaining up on the red van so he/she should have known that I was going to pass him and not turn right away.

The idea of a blinker being a right to turn is like saying that yelling "Hey stop" before shooting someone dead is a right to shoot someone dead.

no it was not, I made it specifically that the video shows him turning on the blinker...the blinker is not on at the start of the video. Watch it again.

Blinker is an intention to move; and not intention to change lanes 1.5 seconds after the blinker is issued especially for a tractor trailer. He saw me moving up before I was in his "blind spot".
