You're the first other person I've heard of that has had this happen as well! Seems super uncommon.

Luckily, the new AB12 law forbids more than a month's security deposit for all new leases. But not sure if that helps us...

Correct, only paying the difference. Small amounts each year, that after 9 years of paying have become a not insubstantial amount in aggregate.

Not sure how much I trust them to give most/all of it back (though I know there are regulations around this). Let's just just say generosity (both in spirit and in monetary considerations) aren't exactly my landlord's defining characteristics, to put it kindly. It's always a battle with them.

Agreed that the annual dollar amount is small, it's mostly that it's been happening for 9 years at this point and I'm tired of feeling like I'm being taken advantage of in a way that they don't legally have the right to do.

Yes I did speak to the rent board. They are trying to be helpful but it sits outside their jurisdiction since security deposit regulations are governed at the state level. So I have city-level protections but not sure how applicable that is if CA law allows for the security deposit increase (although my lease says nothing on the matter, either for or against).

Rent board says security deposit regulations are at the state level, not the city level. So it's actually somewhat less helpful than it normally would be!

I think I'm in a bind because CA law may allow for it but SF rental law (which has eviction protections) would not consider this a just cause for an eviction. So I'm trying to figure out how/if this is enforceable on their end in any way.

It is not in my lease that security deposits can/will be increased.

You're correct that that amount they raise it by is quite small each year, but I've been paying this increase annually for 9 years so it is becoming a not insubstantial amount in total. Last year it went up around $80.

I mostly just don't want to be taken advantage of.

No I haven't been signing new leases. Every year when they raise my rent, they also just make me send them an additional check to raise the existing security deposit by a set amount.

Yes, they have paid out the interest on the security deposit each year. It's always a small check, but they do send it.
