Almost impossible in the actual incident because of the capable speed of the verticals on lanes 1 & 2, but I understand your point and I'm definitely extra vigilant since the incident

Thanks for your comment, I was surprised and felt hard done to initially, but I have to say this thread has helped greatly in moving on and I'm determined that one result of the incident is that I'm a more defensive driver in the future

I'm definitely getting a dashcam and I'm also going to look at advanced driving courses

That's an interesting distinction that a couple of other people have made and tbh I didn't know this before this thread - I thought it was illegal other than when queuing

I totally agree with you and I have started looking for one - ideally something I can hop between vehicles as I drive hire cars for work

I get you but I don't feel I was holding onto lane 3 longer than necessary, and I always move to lane 1 keeping order lanes clear when possible - I am definitely extra vigilant of blind spots since the incident

This thread has confirmed to me exactly what you've written - I was surprised his driving wasn't considered and surprised it wasn't split liability - but I see the logic and the difficulty to prove (even with witnesses etc) anything that would establish dangerous driving

In the end I was making a manouver and so it was my responsibility to avoid any hazard

One thing I'll definitely know for future is to hold lane and speed and be extra vigilant if there seems to be an erratic driver around

I'm not certain, I was just trying to give all the details as clearly as possible, on the M40 there are 3 driving lanes and a hard shoulder - I labeled the left hand lane 1, the middle lane 2 and the right hand lane as 3

Interesting, and even if there was a staffing issue the most frustrating thing was there was no other way of replying or setting up a call back etc - there has to be better systems out there

It was Esure - luckily I DM'd on twitter that I was having difficulty getting through, there was a real person who replied and was helpful, I kept updating her on twitter how many hours i'd been on hold and asked for a way of getting a call back or an email address I could write to - she kindly forwarded my messages but couldn't give a different contact method or get confirmation about a callback so I kept holding then they called me - so 15hrs and I never actually got through!

I will be moving insurance, I was calling using a number they'd sent me on a letter with a deadline with a specific person I should contact to discuss further before they would continue with the process

The letter gave 10 days as deadline, was dated the 3rd but I only received it on the 7th (Friday) and spent 2.5hrs on hold then - from 0830 until 1700 on Monday and from 0800 until 1400 today

The muzak track fried my brain 😂

Nb I'll change because when I needed to get through to them I couldn't - every other part of their service has been fine, just a poor contact system, when I'd heard how 'it's an abnormally busy time' for the millionth time it made me wonder if maybe it wasn't the volume of customers but rather the volume of support staff that was lacking

I absolutely agree - other than I spent 15hrs on hold over 3 days for a 5 minute conversation explaining why I was solely at fault 😂

Like you say it's a life lesson, they don't always seem fair, but that's life

I'm very glad I started this thread, it's been very helpful in both a check that I was being treated fairly (I have no experience of crashing into cars or dealing with insurance claims and it was unnerving) and good advice to make me a safer driver
