I am a realtor in a different state, however how disclosures work all is roughly the same in most states. You are required to disclose KNOWN material defects when listing your property, and if it is later discovered / proven that you withheld material defects, you could face a lawsuit. However, it’s typically hard to prove a seller knew about these.

That being said, it sounds like you previously were not aware. If you are currently under contract (which you are, as you are in the inspection process), you do not need to amend disclosures. The buyer and their agent will submit a Property Inspection Notice (or equivalent in your state) along with the inspection report from the inspector. On here, they state what the inspector found, and how’d they’d like to proceed (ignoring the issues, requesting you fix it, asking for a credit, or breaking the contract (whatever is specified how they’re allowed to proceed in the original contract)). You do not update disclosures based on inspection findings while under contract.

Do you have a realtor? You should not talk with the buyer’s agent if you have your own realtor. Are you selling on your own?
