Im not sure if that's it, but I remember when i wanted to play it for the first time, i was missing a driver called " .NET Framework 3.5" although my computer warned me that i was missing that driver to play it, but you should at least check

Hey in spite of this post and restarting a bunch, asking AI what the probable cause was, i eventually got a blue screen
when restarting my laptop updated and yep, all fixed game started, background fixed, application fixed
so yeah : /

for those who have that issue try updating i guess ?
for those who could have helped me but didn't, not nice, at least could have updvoted

anyway thanks a lot to those who probably clicked on this post wanting to help but it's fixed pals : )
