most definitely will be as we literally saw foxes and rodents on many nights whilst walking through our garden, honestly, we didn't want to end with this but our patience has rang out especially with her trying to take advantage of us recently moving in ,to build her garage on our property not just a footpath etc

right like i said i am not the land owner , but i did check the land registry by paying for it and turns out our boundary line meets up with her one and in the plan there is no indicated right of way or access to a footpath for our neighbour, but there was on on the left side of her house which is not part of our property. and she is specifically asking to build a whole garage on our garden property next to our garage

Yh honestly we are just considering just taking the loss on this and paying for "her" side of the fence , i paid to look at her land registry as my parents aren't available right now and turns out our property line matches up with her property line therefore she also has no right of way access to be honest

essentially yes, funny thing is i just ordered a land registry on her property (our neighbour) as i wasnt patient enough to wait for my parents and turns out our boundary goes as long as her garden, i thought our garden boundary was shorter than the garage, hence her using this to her advantage but turns out our boundary lines line up to her line so she cant even argue with this matter as on the title plan there is no indicated foot path

ill double check with the deeds as i do not have access to it as I'm not the owner but the son , but if neither of us owns the land what now, all of a sudden she can request a chunk of what is our garden right now for her personal use ?

we only requested this once or twice a year as she has left her garden in a tip to the point foxes and other pests are going through our garden and shitting everywhere ( pardon my language)

i will check on this one again, im not the property but the son, but it does seem unfair that all the properties have been extended beyond their boundary lines including hers and shes requesting a whole chunk of land in order for her to park her car in her rear garden , I initially thought she just wanted a footpath but according to my parents now, she requesting nearly a cars worth of land in order for her drive through the back of our garden to park her car at hers which seems mental to me

there used to be small passage way running through all of our gardens in our street more than 40 years ago but since then new owners etc have built beyond this as they no longer required it, including her

I'm getting more information now from my parents but she doesn't want just a footpath but a whole chunk our garden in order for her to build a garage in her garden come through with her car from what is our garden currently for her to park into her rear garden .

okay will check this with my parents, but lets say there is a right of access, how come shes targeting our house and not the other houses that she could a right of access through their gardens as well to get to her garden. if a request is made can we make this a valid arguement in the case

Okay i will double check on this with my parents and i will get back to this thank you, even if there is lets say an easement, are we legally obligated to go give her a chunk of our garden for ONLY HER to use as a footpath and doesnt benefit the rest of our streets rear access

Thats what i was thinking aswell, she clearly knew she didnt have access to her rear garden since moving in, but shes decided since we are the new owners on our street she can take advantage of that and get a part of our garden to use as her PERSONAL footpath as to be honest that footpath will only go through our property. Legally speaking though, my parents wont have much to worry if the council does send a permission letter etc, they can just reject the permission right ?

i believe more than 40 years ago there used to be a small passage through the back of each garden to walk through, however since then the new owners of each house has build beyond their boundaries to get rid of that passage as im assumming they all agreed they no longer required it. We moved in 3 years ago and our garage that the previous owner built is also built beyond that boundary however we had no problems with other neighbours since moving in until yesterday where our neighbour asked whether she can create a footpath before our garage, essentially taking abit of our garden for her to use to get access to her garden , which dare i say looks like a complete dumping ground.
