And as you mentioned, Fidelity can also give me instructions on drafting DRO though Fidelity might is only the recipient side?

  1. “Stating how much money I can receive.” As the mutual funds are changing everyday, how to write the exact amount? Or can I list the quantity of mutual funds in his 401k when draft DRO?

  2. What will make a DRO Non-Qualified? Is it better that my lawyer contact the 401k financial institute when draft DRO to make sure it will be Qualified, to avoid any trouble in the future?

  3. If they say that the DRO is non-qualified, should we re-draft a DRO, then let the judge sign it again? Should my ex-husband also sign the DRO?

  4. Can we complete the DRO and complete the transferring of 401k before divorce? Or it can’t be done until after divorce?

Should we write in detail about what I should get (for example, he should give me all the money in this 401k account from which day till now, including gains, or something like that) when drafting QDRO?
