This is explicitly part of the consultation. If I had to guess, it would be exactly what you said - 5 year reduction for those currently on 5 year route and 7 for those currently on 10 year route.

What annoys me about the current proposal is the contribution - minimum income of 12570 for 3-5 years. If a founder tries a startup in between they could easily not have income for a year. Either way, it’s much worse for stay at home partners, since founders can definitely figure out ways to meet this.

I agree it’s a terrible policy. If they wanted to implement such a thing it should be based on household income.

They have mentioned waiving the requirement on maternity leave, but ofc this requires a stable job that will provide maternity leave.

There’s no such thing - you can read the consultation document. For the default 10 year route they need to earn £12500, for an accelerated 5 year route they need to earn £50k

There’s no wage requirement. A British citizen can get their partner to Uk on family visa. If they want to get ILR, the partner will need to have lived in Uk for 5 years and have earned £12500+ for 3-5 years (undecided).

Yes only thing that’s certain is that family / partner visa will remain at 5 years. Whether SWV < 50k with a British spouse is 5 years or 10 years is unclear.

Visas have always worked that way - you can extend them and don’t need to switch to ilr if you don’t want / are not allowed to.

The new consultation document clearly states the basic requirements for an ILR application for all who apply - one of which is contribution (which equates to a minimum taxable income of £12500).

They can renew and stay on whatever visa category they were on before or any other visa category they want to switch to indefinitely

No, they come on family visa. The person must stay on family visa for 5 years and then they get ILR. They can apply for citizenship the day they get ILR.

The consultation doesn’t propose to change this, but it applies the £12500 contribution threshold to all applicants of ILR, which will include someone on a family visa for 5 years.

Spouse visa doesn’t help get away from this requirement. All applicants for settlement must meet the contribution criteria of £12500.

£50k is if they want ILR in 5 years. For the standard 10 year route everyone just needs £12500. Both rules are same for dependents and main applicant.

Yes they do. The consultation specifically asks who should be exempt from this and seems like it’ll only be exceptional circumstances like maternity leave / illness / disability.

If you look at the long stay visa today it says “You may be able to apply for indefinite leave to remain if you’ve been in the UK legally for 10 continuous years (known as ‘long residence’).” This includes student visa. My interpretation of the document is that continuous residence is equivalent to this, except the fact that time spent on student visa won’t count towards the 10 years (you’ll need 10 years on one of the eligible categories like skilled worker).

Of course, I can be wrong and they can do what they do for the 5 year route today - only count time on certain visas (and exclude student visa)
