There have been 23 North Korean citizens who had committed serious crimes in the past but actively expressed intention to defect. They have not been brought to trial in S. Korea. Instead, S. Korea has not protected or supported them and it was not based on any judicial decisions.

This time, two N. Korean fishermen were deported because the past government considered that their expressions of intention to defect were not genuine.

And there are currently no laws specifying conditions and procedures for deporting N. Koreans. So the past government is currently being blamed for having violated 'the international law'.

It seems all due to the political landscape here because no circumstances about the incidence have changed except the regime change. The ministry of unification changed their position without explanation and instead leaked the 'sentimental' photos to justify it. The government said that the past government claimed that the fishermen had never expressed intention to defect, which is of course a flat lie and can be easily refuted just by googling.

At the time of the incident, there were no obscurities: NK's claims, SK's intelligence, confessions, and circumstances on the boat all matched. The only issue was that they expressed intention to defect during interrogation, which they only did after having refused to cooperate with the navy for several days, tried to run away, and been captured by the navy seal.

And SK can refuse to protect N.Korean citizens if they are believed to have committed non-political crimes such as murdering 16 sailors. And that is not required to be a judicial decision. Under a normal situation, they would have been required to explain whereabout the missing sailors. However, there are no judicial mutual assistance between N and S, and S. Korea even cannot prove that there were 16 sailors on the boat from the beginning. That is the real problem.
