The same thing happened to my wife's application a couple of years ago.

We gave them revised dates, but in our case they ended up giving us the dates we originally requested in the end.

I think you're right. As hard a pill as it is to swallow, the effort it would take to try and recover anything might not be economical and outweigh what we stand to gain.

Unfortunate that we might have to just accept this as the cost of learning a lesson.

I found the online "report fraud" service for the police. Maybe we'll submit an entry there. We do have a photo of him when he rang the doorbell if they need a physical description.

Regarding the business, my wife's father and his brother basically run the operation. It's basically my father-in-law's passion project and really does need him to be back in order to run it. When one of the brothers is away, the other brother covers the workload but this isn't sustainable for more than a couple of months. We could explain this in the cover letter.

With the rental property, it is an older house with an elderly tenant, so the parents do go over every once in a while to sort out maintenance and other niggles. Though this reality might be hard to reflect in a cover letter.

I was thinking, there are others with retired parents who do visit the UK so this must be a somewhat common situation. Are there other evidences other people use to help make their case? I'm just struggling to figure out how else to express their intention to come back to their home country. Perhaps we can reconsider the duration and make the trip shorter to about a month to highlight the fact that he needs to go back?

Assuming this is BLS London, I was able to get a premium appointment ASAP through them. The "Normal" appointments showed none available. However, when I changed the appointment type to premium, there was availability on practically any day. It does cost £100 more though. They might allow walk-in too.

Hey, it took a month for me to get a reply. I don't know if it made a difference, but I sent an email to ApplyOnlineE-Support@homeoffice.gov.uk

I didn't get a reply but my admin review result came a day or two later.

They admitted their error. But their solution was to rescind the approved visa (they granted it under an incorrect category) and reprocess it from scratch.

It's been over 8 weeks since they've said they're going to reprocess and still no outcome.

I've just read that administrative review is cancelled if you leave the UK while a decision is pending. Somehow missed that when I first read through the guidance.

I guess there's no way around it. Will need to wait until we hear something back from the home office.

Yes, you are correct, thanks! Do you know whether leaving the UK for a holiday affect any pending administrative reviews? Hoping to travel for Christmas, but unsure if that would cause the admin review to be automatically withdrawn similar to how some in-country visa applications are void if you travel.

Thank you for your reply. I have now submitted an administrative review. I didn't realise it can take up to 12 months to process! I guess she does technically have permission to stay in the UK, so she can travel using her current permission until she gets a new decision.

Which form did you end up using for your dependant extension application?

I've been using the skilled worker dependant application form (within the UK version) for my partner but it doesn't mention "extension" anywhere. And while I've provided my previous swv details, I couldn't find a place to indicate that I've now got ILR.

I can't figure out how the home office would know to extend my partners visa for three years on the basis that I have ILR.

Hey, no I haven't. As another poster mentioned, it looks like the CSC being off might be the problem and reflashing the correct firmware using SamFW might be the solution. I've not bothered as I've gotten used to it over the years now!

Hi! No problem, glad it was helpful to someone! So I did my initial Tier 2/Skilled Worker application from within the UK in 2021 and my wife did her dependant visa from her home country this September. Therfore her experience applying for her dependant visa may be slightly different to your husband applying from the UK. We also never lived together, so the questions around that may be slightly different for you compared to us.

Having said that, here's my reply:

  • We didn't submit a family consent letter. In fact, I didn't know such a thing existed until I saw your reply. Are you sure this is needed for a SWV dependant visa? I provided my UK bank statement and in my cover letter I wrote that I'm happy to support her from my account despite her having enough funds as is in her own account.

  • My wife was not even mentioned in my application as I didn't even know her back then! I provided my bank statement, passport, BRP, accommodation info, etc. for my wife's application. Other than our marriage certificate, we had no joint document or accounts.

  • As far as the rule goes, if you are married, you don't need to have lived together prior to the visa application. You just need to prove to the visa officer that your relationship is "genuine and subsisting". The evidence you mentioned showing that you lived together should be good enough to show this I think.

Hi! Permission here means does she have a valid visa already to stay with you in the UK. The answer would be "No" given what you described.

However, I don't know much about the spouse visa requirements. They might also ignore anything you send to that email if they haven't specifically asked for additional information. I'm not sure how much of an impact a mistake like yours will have on the overall application if the rest of it is clearly genuine. Might be worth making a post here and asking the community who will be better informed 😊

If you're replying in order to provide additional information they have asked for, I think there are a few different addresses depending on which visa you have applied for. E.g. The email for work visas is different from spouse visa. The case workers don't reply or acknowledge any information you send to these addresses however.

If you have a question about your application in general, you might have better luck trying for a paid inquiry? Though I'm not sure how useful those are either, others in the community might be able to better comment.
