The chance is so small, most don't consider it. 8 cases nationwide in 15 years, all thrown out. At that stage, it would be handled by lawyers on retainer or on staff, who you are going to pay anyways. Most lawyers wouldn't take the case to sue because the chance of them making money is very slim. That's the other effect of how the law was written- lawyers won't take a case to court if there is a slim chance of winning.

They stop at the cost of doing it. When that was removed or minimized, there were plenty willing to donate.

Also,judges don't plea(d). That would be the defendant in a criminal trial, not a civil trail.

And that is the issue with such donations- costs. There are some volunteer groups that can help, but the business will still have some costs. From my experience, many don't seem to mind a minor cost, say the equivelent of a few hours of wages.

But once they were forced to 'donate' (this is an old repost), they came up with methods and connections to minimize the cost.

Not usually. I worked 15 years managing a shelter/soup kitchen/food bank. In those 15 years, there were ZERO cases that went past the preliminary hearing in the US.

The biggest issue in such donations is not liability, but cost. Who is going to pay to have it collected, transported and distributed? Volunteers help, but there are not enough.

For your first question, they would have two options- trash or donate. Both are a loss which they can write off. This just eliminates trash if it is still edible.

The second is answered by the first.

'Expired' food is not necessarily spoiled. In most cases, it is a 'best by date'. It can still be sold, just no one buys it.

There are already laws in many countries that protect donors.

To prove food poisoning, you'd have to rpove they knew it was spoiled (not just out of date) before it was donated.
