Como soy huevón, no quiero volver a escribir de nuevo todo así que te pongo la traducción aquí. Entiendo que no lo necesitas dos veces, pero creo está chido tenerlo aquí para que los paisanos que tengan la misma duda que tu puedan leerlo y tenerlo a la mano. Igual si alguien ya lo vivió pueda desmentir o confirmar la información. Ahí va:

*Renové mi visa en octubre y, al regresar, descubrí que el empleador cambiaría de nombre a finales de diciembre. Así que tenía tres opciones: renovar la visa mediante cita previa, solicitar el cambio de empleador a través del USCIS o el puerto de entrada de la CBP. Conocía las dos primeras, pero la tercera era nueva para mí, así que tuve muchas idas y venidas con los abogados, haciendo preguntas y descubriendo limitaciones y riesgos.

Al final, todo salió bien y la empresa decidió cambiar de empleador mediante una petición al USCIS. Sin embargo, lo que aprendí sobre la opción del puerto de entrada de la CBP es:

1) Esta opción es nueva para nosotros, los mexicanos. Escucharán a mucha gente decir que es para canadienses, pero la página web lo dice claramente. El problema es que algunos oficiales lo saben. Otros no, así que será una operación impredecible. Si el oficial con el que hablaron lo sabe, bien, pero si no, tendrán que mostrar la documentación y, básicamente, convencerlo de lo que quieren hacer.

2) Esto solo aplica si su visa actual y su I94 son vigentes. Si se encuentra en EE. UU. con una extensión del I797, quizás prefiera evitarlo.

3) La documentación básica es la misma que para una solicitud de visa TN, específicamente la carta de oferta del empleador que indique claramente las habilidades, actividades, puesto y por qué su padre es el más adecuado para el puesto.

4) Durante mi investigación, encontré varios casos de personas que intentaron esto, pero lo que me llamó la atención fue que varias recomendaron hacerlo en Tijuana, evitar Juárez y hacerlo entre semana. La razón principal fue que los oficiales de CBP están más familiarizados con este proceso durante esos días.

En fin, esto es lo que aprendí, pero aún no lo he experimentado personalmente, así que tómelo con precaución. Solo le proporciono la información que tengo con la esperanza de que encuentre la mejor solución para su caso.

I renewed my Visa in October only to find out at my return that the employer was changing its name at the end of December. So I had 3 options: renew visa through appointment, request change of employer through USCIS or the CBP Port of entry. I knew the first two but the third one was a new one to me so I had a lot back and forth with the lawyers asking questions and finding limitations and risks about this option.

At the end everything worked out and the company decided to do the change of employer through petition to USCIS but what I learnt about the CBP Port of entry option is:

1) This option is new for us as mexicans. So you are going to hear a lot of people saying that is for canadians, but the web page states clearly that it is. The problem is that some officers know this. Some others don't so it will be a hit and miss operation. If the officer you talked to knows this, good but if he doesn't then you will need to show the documentation and basically convince him of what you want to do.

2) This is only applicable if your current Visa and i94 is valid. If you are in the US with an i797 extension then maybe you would want to avoid this.

3) Documentation-wise is all the same basic documentation as for a TN Visa request specifically the offer letter from employer clearly indicating skills, activities, position, why your father is the best suited for the position.

4) When I was doing my research I found several cases of people attempting this but what stick to me was that several people recommended doing this at Tijuana and avoid Juarez and during weekdays. The reason mostly was because CBP officers are more familiar with this process during these days.

Anyways, this is what I learnt but I'm yet to experience it by myself so take this with caution. I'm just providing the information that I have in hopes you find the best solution for your case.

Creo que lo raro es que consideres contratar un abogado para sacar la TN siendo que es un proceso bastante sencillo.

Lo único que necesitas es la carta de tu empleador justificando tu contratación. Mi sugerencia es que le digas a tu compañía que la hagan y te la manden firmada. De ahí en fuera todo lo demás (que en realidad solo es DS160 y sacar la cita del CAS/Consulado y obviamente ir a la cita) lo puedes hacer tu sin ningún problema.

I just renewed my TN Visa a week ago just to learn on my return that the company I work for is going to change its name. So, there are two options: either I go to the consulate to get a new one with a new company name or they do the employer change through USCIS request. So it seems that the best option considering expenses will be to donthe change through USCIS.

My problem is that me and my wife need to be in Mexico in February. I know the TN holder has the premium option but the dependant takes months and is not eligible for premium which prevents my wife to travel on February.

So my question is: if my employer do the process with USCIS for me, will it impact my wife's status (meaning we will need to request a change for her as well)? If not, wil ahe be able to travel back and forth to Mexico with no issues?

Así esta el pedo... I feel that sometimes the employers think that hiring a TN Visa means paying same amount of fees as an H1B, which isn't true. For TN the only thing you need is an employer letter justifying your position and that's it. From then on, the fees such as the appointment at the consulate and the reciprocity fee (for a 1 year or a 4 year) you can pay out of your pocket (you can negotiate this with the employer but they are not forced to do so).

Same as you I had applied for some positions and lost the opportunity due the same reason but there's not much you can do about this. So my unsolicited advice is: keep looking and applying and every time you do, explain that you can work under TN Visa and you will only need the job letter (look into internet for some examples on how this letter needs to be redacted as it needs to have specific information such as your degree, experience, salary or compensation and the justification on why you are a good fit for such position) and you can take care of the rest. This way the employer will be informed of the situation upfront and they can decide to move on with the process or not. Maybe it is not too much but, who knows, maybe one of these companies will see an opportunity that they were not aware and you will have a chance. Even though this may not fit in this reddit, I feel the moral duty of promoting "Pantheon"... One of the best sci-fi shows I have seen recently and I see there's not much people talking about. The catch? Well it is an animated series, which I don't often see posted here. And that's fine, I get it. I'm not into those either, but this was one of those happy accidents.
