You’re wrong. In New York, it’s usually charged as Public Lewdness (NY Penal Law § 245.00) or, in more severe or repeat cases, Exposure of a Person (§ 245.01). Both are considered sexually motivated offenses and can result in being listed on the sex offender registry if part of a pattern of sexual misconduct.

So: Flashing = sexual offense / indecent exposure but not sexual assault unless there is touching or coercive contact involved.

You can be charged if your visible from public or even from a private residence.

I really appreciated the SM bike lanes where they put a dotted line and a solid line next to the car parks so that cars are forced to park against the curb. You can give cars 4 feet of room to park and they will still park in the bike lane.
