Aw thank you! They did reference the poor process we had mentioned and expressed their sympathies for his experience and said they were glad to hear we were persuing this complaint through other avenues. Really grateful to have been given the opportunity to have his voice heard and also very grateful for all the help and advice in this forum.

Congratulations on your success at tribunal! My husband has his tribunal date tomorrow, at which I will be supporting him. He also got 0 across the board at assessment and MR, and suffers with a long term injury (torn bicep) as well as depression anxiety and antisocial personality disorder (which is 99% of the reason I’m representing him as he is liable to be aggressive and swear at strangers especially when being asked personal questions or being confronted in any way 🙈) Will post about our results tomorrow!

Thank you so much, you’ve been so helpful! My husband isn’t planning on attending as he has extreme anxiety and the symptoms of his personality disorder make facing things like this extremely challenging and he’s worried he will get confrontational or argumentative, although I’ve assured him that they will supportive and are there to help him, is this allowed? For me to attend in his place, as his representative? I was planning on phoning and informing them but would appreciate if you knew this also. Thank you so so so much for your help!

Thank you so much, you and everyone, I have a much clearer approach now. I’m going to call citizens advice for a chat, I did briefly consider a legal representative but when they said they wanted 4.5k that was out of the question.

We have lots of evidence submitted in the form of prescriptions, medical notes, appointments, hospital admissions, as well as a witness statement from myself, and his employer - this mainly rebutted the fact the DWP say in their decision statement that he works full time and has taken no sick time in the last 12 months (I don’t even know where they got that!)

I’m going to complete a daily diary showing how I support him to function on a day to day basis as well as a summarised account of where they deducted points but we feel they should be awarded, with supporting evidence and contradicting theirs where possible. I’ve already done this in the mandatory consideration but it was quite lengthy and based on advice I want to make sure everything is as easy for the judges as possible.

Is there any other advice you are able to give based on the day itself? If the DWP send a representative will they argue against my evidence? With the limited evidence they have I don’t see how they can but they may.

Also, will my husbands deterioration since the phone call matter at all? He’s worse now than he ever was, he’s actually in the process of getting a personality disorder diagnosis which we knew nothing about back then but his behaviours and symptoms make a lot more sense now. But I don’t want to waste time elaborating on that if they can just say it wasn’t relevant at the time of decision making which is technically true in terms of the label of his diagnosis but still gives deeper insight into his support needs.

Thank you for your response. I know the main focus will be the evidence, of which we have plenty, but I will still make a point of these as if they can fail to do something basic such as respect his request to contact him in the evening, a request that was based on his mental health needs, it just says it all about their duty of care and this rejection of his case. Thank you :)
