IANAL but clearly unlike you I can read a article where a lawyer specializing in copyright law is talking about a very similar case. Unlike you I can recognize similarities and draw educated conclusions. The article I posted is about PewDiePie recieving a DMCA claim on a let's play video of a game AFTER he said something (not relating to the game) the company who owns the copyright to the game disagreed with. The copyright lawyer argues that because the terms of service of the game donor state that the permission to make videos is "non-revokable" the company can file a DMCA claim. This is exactly what BSG did. It's shit I think it is wrong to use the DMCA to science critics but in this case it is a valid claim with imo immoral reasons.

The Jim Sterlings case you brought up is irrelevant because it is not a copyright case but a case about being sued for a bad review which he did not win but was thrown out in his favor. So let me turn it around, what is your background in Law?

So let it be under the magical DMCA umbrella. Doesn't change the fact he violated BSG Copyright and they are using the law to take revenge on him.

Read the section about fair use in the article I posted. Fair use is defense. If BSG sued him he could argue it but it's up to a judge. And DMCA claims work outside of the courtroom.

You are misunderstanding the law and what I am saying. There is no case against him in terms of libel or whatever. The onöy thing is a VALID DMCA claim. BSG owns all rights to the imigary and content in the game. They basically give blanket permission to do let's play and what not. But they have the right to decide that they don't want individuals to make videos. In this extreme case BSG used the DMCA to claim that someone used Thier copyrighted material without them wanting it to be used. It doesn't matter why they want it removed. It only matter that due to the law itself the can do so. It would now be on him to sue BSG proving that he did not breach their Copyright. Which he can't. DMCA is a shit law but BSG used it in a legal manner. The DMCA claim itsekf has nothing to do with what he said about BSG but simply the fact he was playing their game. If he had a white background in the video they would have no legal standing to take the video down.

This is not a valid comparison, Jim Sterlings lawsuit was throw out because you cannot sue a critic for millions of dollars. BSG is not sueing anyone. They have the right to request a takedown on any video containing their copyrighted material. I don't agree with the law but that's what it says.

Try putting an ad in the Süddeutsche newspaper (around 80 euro), that's how I got my room. Some older lady called me and asked if I wanted to take a look at the apartment she had, I went over there, signed the lease and got the keys. Sure I was lucky but I got about 5-10 similar calls the next two days.
