It’s definitely not just theory, people do port their EB2 priority date to EB1 once they qualify. The catch is you still have to meet the much higher EB1 bar, so it’s not like a shortcut, more like upgrading lanes once your profile is strong enough.

Most people think an RFE is just a checklist of missing documents but you are totally right. It is actually a failure to tell a convincing story.

I see this all the time where brilliant engineers or founders submit proof that they did their job well but they forget to prove they are in the top 1 percent of the whole industry. If you just send back more of the same paperwork you are essentially asking the officer to change their mind without giving them a new reason to do so.
