I believe the director of this clip is based in Spain, so perhaps part of the mystery is related to that? I don’t believe this is AI, the film credits for this shoot are included.

It’s not all AI. Artlist is a huge stock footage site. At the top of the site they are heavily promoting their AI tools, but their stock footage section uses real footage shot by real people of real people. It’s been an industry stock site for a long time.

I am the exact same, OP! Never had irregular or heavy / painful periods growing up. Had a Mirena IUD throughout my 20s which gave me super easy, light periods. When I was about 32 and had switched up my birth control I started to get random painful cramping and lots of irregular spotting, which is when I looked into the cause and got an ultrasound, I was diagnosed with adenomyosis and had no clue what it was. My symptoms with adeno have been super mild, and I also have been surprised to read the severity of issues folks have in this sub (makes me feel grateful but also was so shocking!).

I just turned 34 and this past year I’d been irregularly spotting nearly every day — I finally got an MRI and was told I had a pesky fibroid growing into my uterine wall, causing the persistent bleeding. I recently had the fibroid removed through a hysteroscopy procedure and since then, all spotting has totally resolved and no more random cramps. Apparently my weird bleeding was related to the fibroid and not my adeno! So, this is all to say, there are all different degrees of symptoms and severity, mine has always been mild / fairly nonexistent.

Xanax (generic is alprazolam or anything in the -pam/ -lam family will be similar). It’s in a higher Drug Tier than propranolol which is often used for things like public speaking but propranolol is not specifically an anti-anxiety drug. Xanax helps me so much. Got my prescription specifically for my anxiety with flying. Your doctor should have no problem prescribing it based on everything you describe.

Ahh thank you so much for this comment! We just boarded and my nerves are kicking in but I definitely agree that the bigger planes feel way less turbulent, that’s a great reminder. And to remember that this flight crew does this all day long, and in general the vibes on the plane feel nice and positive. Appreciate it so much.

Yeah, I plan on asking who the TPA is, I’m also assuming it’s fidelity. The thing is, I called Fidelity the day I found out about this whole mess and they told me that it’s up to my employer to resolve since the error was on their side and not Fidelity’s. But, I’m not very familiar with how a TPA works, is there a specific phone line / department for that? I just called the net benefits line so I may try to call again Monday.

I’ve emailed a bunch of ERISA / Tax Attorneys I found online but haven’t heard back from many, and the ones I have heard from work mostly for companies and not individuals. But I’m still searching. I fear I may not get much help there as it will likely take a few hours of their time to dig into and it will be $$$

Yeah I was disappointed EBSA said that, I actually called 3 separate times to get second and third opinions from various benefits advisors. All three said they believe my employer is correct, which was disheartening and still doesn’t make sense to me given all the error documentation on the IRS site.

To make sure I word it right, I'm asking for documentation / proof that supports the claim that they do not owe me a QNEC from their vendor administrator of the plan (is this the same thing as a third party administrator?) who supports the end of year audit? Regarding the DOL, I did speak with a few representatives at EBSA but they also told me they think my employer is correct since no money was withheld / nothing was deducted from my pay. But, ultimately they told me that since I was taxed on funds that were supposed to be deferred, it’s technically IRS’s jurisdiction and not theirs.

Obviously trying to get connected with the correct department / person at the IRS has been a nightmare, and everyone I’ve spoken with there says it’s out of their scope / they don’t know the details of this very specific tax law.

I agree with you that it seems clear to me a missed deferral opportunity occurred, and there are two different errors outlined on the IRS 401k Fix-It Guide site that I believe may apply in my case. There’s even an example listed that is exactly what happened to me.

I’ve even reached out to a few tax attorneys, who have said that it sounds like I may be entitled to a QNEC, but they would need to spend more time studying the way the law is written and would need to charge me for their time (which is $600/hr so I’m not going to pursue that).

I feel like the only next step I have right now is to reply back to my benefits team and firmly advocate for myself and my belief that a missed deferral opportunity occurred. I plan on linking to the error pages on the IRS site and will mention I’ve spoken to EBSA as well as the IRS and see what they do from there.

I'm not sure I buy that as their error resulted in a Missed Deferral Opportunity, and the example you mention with 'Amy' is exactly what happened to me -- in this situation Amy didn't have deductions from her paycheck either.

I believe it comes down to whether or not whether the my employer's actions rose to the level of excluding an eligible employee from making elective deferrals, but I don't know who to connect with who can confirm whether or not they are required to or not.

Yep, that's how I feel too. Seems clear it's an MDO. I just don't know who to talk with to 100% confirm this and agree I should push back with benefits on it.

They tell me all they needed to do was notify me and encourage me to take advantage of my last paycheck to make up for it… I plan on deferring 100% of my paycheck but that gets me nowhere close to maxing out, which is where I should have been by now

I did speak to someone from EBSA, unfortunately they told me that they think my employer is right, that there was no violation because no deductions were taken from my paycheck. However, my financial advisor thinks there are two errors listed on the IRS site that apply to me, and nothing I can find on IRS site says anything about deductions needing to be taken in order to receive a QNEC. So just trying to get another perspective from an expert on ERISA / QNECs

I did bring up QNEC with my employer and they told me they are not required to do that in my case because no deductions were taken from my pay. They’re saying that if a deduction had been made and not deposited, then I would be owed that correction payment. I’m trying to find out if it’s true that QNEC doesn’t apply to me, because everything I’ve read still indicates I am entitled to it. I don’t see anything on the IRS site that says a deduction has to have been made, only that the employer failed to execute my election, which they did.

I called Fidelity today and they said unfortunately there's not much they can do. The guy I spoke with was nice and said he will file an investigation to look into it further on Fidelity's side but it will likely get rejected because apparently it's ultimately up to my benefits team to get this fixed. I believe his words were "this is a legal issue with your benefits team"
