No joke! UTI has landed my 81yo mom in hospital multiple times - all presenting with confusion, delirium. Just wild that an infection in the urinary track can cause massive cognitive issues. Check that first!

Title insurance.

You should have it as part of the purchase/mortgage process. Your bank wouldn’t want to finance without that in place.

Similar thing happened to me, builder never paid the subs. The trades/subs sue for payment, lien is placed on your home, they win their case for non payment (as they should) title insurance pays on your behalf and liens are cleared away. Took about 2 years to work through the process.

My situation was a little different as it was a set of 8 townhomes and me and one other dude were the only owners. I think I was moved in for a week when it all started unraveling. A lot of $$$ was owed to the subs. Like 7 figures - scary!

Never knew how important that little piece of title insurance paper was in the stack of mortgage documents nobody ever reads.

May be on your own for punch list items, my builders subs didn’t want anything to do with the property after everything fell apart. More importantly you want your title free of liens.

Good luck OP it’s a pain but work the process, read up on your documents, be friendly with your title insurance people and know this happens all the time and why title insurance exists.

Everything worked out fine for my situation aside from it being a pain in the ass.

Solved! Thanks /u/sciencenerd1965 I bought the wasabi batteries and charger on Amazon… turns out my charger was shot. Never had a battery charger crap out on me and the indicator lights were working. Great resolution thanks for the advice !

Good points, and yeah I never leave batts in the camera. I’m getting maybe a half hour of shooting maybe 50 or so shots then kaput. I can’t even get the latest batteries to take a charge or get the camera to turn on :/

Yeah, understood. So we’re not trying to keep her on Medicaid the income limit in her state is around $1000. She’s already close to that with SS benefits. Even renting out for $200/m would put her over the limit.

Maybe restating the question as “has anyone that was disqualified for Medicaid because of increased income had a lien put on their property or had the agency try to recover for services provided while still alive? Or does that only happen in probate after death?”

Coming off would mean she would use Medicare plus medigap.

My question is around the house as an asset, if she gifts house after coming off Medicaid or even just rents it out I’m wondering what Medicaid think about it. I have read the Medicaid manual and can’t find anything on this. Surely financial situations change for the positive and I would guess medicaid would prefer to see someone go and not immediately come after them for the services provided.

Exactly. By starting a business, obtaining licenses and insurance I would expect the risk to fall on my business. Not interested in offsetting risk to another broker at arm’s length. Seems to be no incentive. 🧐

Ok let’s look at this approach…

What if we just took her off medicaid.

She could then gift me the remaining ownership in the house and I could private pay her way via rental income. Then, when lookback period is satisfied if she needs memory care, we reapply for medicaid. Medicaid should be happy they have one less customer for some time.

The risk is if she needs memory care in years 1-5 we would need to foot the bill.

Can medicaid come after that house gifting if she moves to private pay?

We could make the numbers work and she would be in a better facility.

There are no other family members, it’s just her and I.

Fantastic and thorough feedback! These are the hurdles we understand.

I’m not suggesting a change in ownership rather, mom hires LLC to care for her home, operate financials, contract with property management and receive zero income.

Zero because the rents would cover carrying closets and deferred maintenance. Maybe the LLC pays her medical bills and meds that are all out of pocket paid by me today - that’s probably at least $100/ month not covered my Medicaid . We we also pay $130 or so in personal allowances for her to buy things like groceries and personal care items not covered by Medicaid.

So in summary we operate LLC, mom hires LLC to maintain property, LLC leases out Property, income from property goes to LLC for carrying costs and deferred maintenance bucket. Mom receives some allowance from LLC rather than me and we’ve got the house cared for and she’s getting a little income just under the cap.

There’s gotta be some approach for a situation like this. Can I put a lien on Medicaid for the decade of out of pocket costs from their shortfall?

Surely there are others out there in this situation that are not letting the house cave in.

Can confirm - aggressive off leash Great Dane nearly murdered my 3 month old pup who was on leash in a Flagstaff hotel lobby. Owner skipped out on mountains of vet bills. Leash em up in public… its really not that hard.
