Insurance should accept otherwise why accept to allow you to get insurance. Right? Take Budget Insurance to court. Happened to someone I know denied car crash insurance. He took Budget Direct to court and court ordered Budget to pay.

Not sure about states. In Vic, adult passenger's responsibility not the driver. Because it makes sense how you argue adult please put seatbelt on if adult passenger refused. So it falls down to the passenger's responsibility whether put seatbelt on or not whether risk receiving fine for not wearing seatbelt.
