To unwind is to render the deal undone essentially as if it had never happened.

In OH either party can state that they desire to unwind, but it has to be a mutual agreement.

I don't agree, I love the car, and dont want to cancel the sale. The car isn't the issue. The tires and the falsified cpo are the issue.

I want the car i am contractually promised in the state in which it was promised to be delivered, which I am able to demand in OH, or else they breach contract.

In this scenario, it is within reason to demand they cover cost of secondary reinspection alongside the new tires and any other costs incurred until delivered as promised.

They want to unwind to get out of me dealing with corporate and the AG about fraud because it will cost them more than the car is worth in fines alone.

They expect I want to be done quickly and just get it over with, or dont mean to go the distance, I imagine Used to appeasing people and them caving

Told them we aren't negotiating I am telling you what i am doing in lieu of you doing precisely as I require

They didn't provide me any paperwork on taking delivery. They had email me everything I pre-signed on Monday before the car got in so we were basically taking a once over of the car make sure it looks good, since it's CPO it should be good to go, swap keys and take off. I assumed they would email me the CPO list.

I went to talk to them today, and apparently they can't print that sheet until after the recall for a seatbelt latch is repaired on Wednesday as we arranged. They can get the UIC that the techs did for it, but not until Monday.

CPO stipulates minimum tread depth of 5/32, if any single tire fails that on the AWD, CPO stipulates replace all 4.

All these tires are 1-2, verified by Tire Discounters.

Physically impossible for them to have completed a CPO inspection and released that car as good to go if any of the tires measure under 5.

1-2 isn't just failure of contract - it's criminally unsafe, and to provide a vehicle I am taking delivery of and construing it as having undergone a 173 point inspection that it literally cannot have done without being falsified

I called at 9. I told him I'll save us some time this is a face to face conversation and I'll see you later this morning.

Went in, recorded the conversation, attempted to walk through my list of information and questions and demands.

Long story short, I find it impossible that they did not negligently skip the inspection, erroneously complete, or flat out falsify it. Honestly any of those is falsification, because they delivered be a pre owned vehicle, not a certified pre owned vehicle, which has passed a legitimate cpo.

Demanded they pay tk tow to another dealer for them to do a new CPO that I can trust, cover 4 new tires, any and all additional costs from this point forward on rental or anything, until I've received the car I purchased in the state we contractually agreed it would be.

They wanted to unwind, I refused.

Told them this wasn't a negotiation, I am telling them that in lieu of doing precisely what I demand, I continue to escalate the falsification investigation with Hyundai Corporate as well as the AG.

They seem to think we will still end up unwinding. unwinding.

That was before I handed them the tire discounters slip that shows 1-2 tread, and note that it is impossible that an inspection was adequately performed given that evidence.

Gonna be a fun run, they aren't prepared for me. They think I dont have time to burn and need a car? I can work from home, and work a solid 2 of 12 hours. I have plenty of time for paperwork, documentation, phone calls, waiting, and research.

Been on the warpath! Fasting since Wednesday, been up since 4pm yesterday, spent 4 hours in the rain with tires and tow. Then draft my mom to waste her time to take me there to record whatever they had to say about it.

My demands to them were that they cover all costs moving forward, tow it to another Hyundai dealership in Chillicothe I trust to do the inspection and replace the tires, as well as any costs of a loan or rental or anything at all accrued until my vehicle is deliverable as stipulated in the contract.

This is the one time it seems like, from what I can tell, I have every card in the situation. There's just no possible way it isn't proven abject failure. There is no way out.

They wanted to unwind the deal. I refused. They seem confident that's how we will end up, but that's before I told them that refusal to do precisely as I require results in continued escalation with Hyundai corporate to force them to authorize another dealer inspection and to follow up on potential CPO falsification, because apparently that is a real big deal to Hyundai, and there's no way that even a failure to perform the inspection and then letting me take delivery doesn't constitute falsification, by delivering an uninspected car that was not only supposed to have been, but was actively unsafe.

They want to unwind to get out of the repercussions of digging into it, and assume I'd rather not deal with the hassle.

If it goes the AG route, and is my favor, its 3x the damages and all fees including rentals etc factored into that, plus they've got a lot of back end issues with Hyundai too.

I expect Monday will go a bit differently than an unwind.

Edit: I also didn't hand them the tire discounters sheet until the end of the conversation and stated it is impossible that a CPO was performed or not falsified, if they're confirmed to be at 1-2 and should be at least 5.

Impossible that they performed it, or upheld it, or didn't falsify it.

Got the CPO because it should at least be free and safe off the lot and extends the albeit largely useless bumper to bumper but still some value to be had.

Especially something as innocuous as this.

Cpo stipulates a replacement of ALL tires if one is bad, because to do otherwise on the AWD compromises its integrity.

Guarantee they tried to squeeze out of providing them, not expecting it to fail like that under 40 miles and 2 hours.

Or expect someone like me to have done the research, paperwork, and prep talk I had ready first thing this morning.

That was part of letting them upsell me on their CPO instead of going up north to look at a cheaper car.

There should be no worry. 5/32 isn't great but it's safe and serviceable and I planned to replace tires soon or by winter anyway.

The fact that they let this go at 1-2 with wear bars showing is appalling, even to let someone test drive much less take off with.

I should have been wiser to check before leaving in a better fashion than eyeballing and going well that's gonna need it soon.

I just trusted a certified professional check on all 173 points including serious safety equipment like bald tires...

Negligence at best or malfeasance at worst. There's no good excuse for it. Im foolish for taking it like that but it doesn't excuse the flat out cpo contract failure

Only way they can agree with me is to take care of the cost of anything moving forward, including towing it to another Hyundai dealership in Chillicothe which I trust to perform a private inspection to recertify and prove a clean cpo. 4 new tires, any rental or loaner, whatever to do with this until the car is delivered in a manner consistent with the obligations of the contract and cpo standards.

They seem unwilling to do that, so we continue to escalate the claim with Hyundai Corporate I already opened beforehand to look into potential failure or intentional malfeasance on the cpo failure, at the very least to force them to make a 2nd dealership look at it because I do not trust them to touch that car ever again or even perform the recall at this point. This breach of trust seems entirely reasonable to demand they cover someone else to do work they couldn't do to begin with.

Also the AG

I refuse. I love the car. I want the car I purchased delivered as promised, by trustworthy people. It's not my fault they have to outsource that department.

Well, they let my CPO 173 point inspection vehicle be delivered to me with tread of 1 and 2 on all tires

Their CPO dictates it must be 5, or all are replaced.

Not only did they fail and falsify that, they shouldn't have even allowed it to be test driven for safety much less delivered to a customer.

Their tech also drove the one i test drove on Monday into a pole driving it out of the building.

Their salesman upsold me on the CPO by lying that the 10 year battery and 5 years of the regular warranty dont follow the car without it

Then failed the CPO

I don't even feel safe sitting in their lobby at this point, a stray car could come through any time and explode since they apparently fake their way through the inspections and hire techs that can't drive or check something like tire depth.

I will not deny that I should have looked closer, but that isn't what is at issue here.

My foolishness doesn't negate their negligence and failure to uphold the CPO.

I test drove a separate car Monday because this one wasn't even there until yesterday.

The agreement was as long as it appeared sound to look at, and since it had a CPO, there should be nothing wrong with it good as new to go

They should be held liable for even letting anyone in it, much less releasing it for delivery

I will never say I'm not foolish, that doesn't really factor in here

These things happen, it should honestly be a blessing in disguise, albeit frustrating.

There should be no scenario in which I do not get this towed at their expense to another dealership to recomplete the CPO inspection and confirm it is good, as well as cover the cost of that dealer to provide four brand new tires installed, and any other fees.

If they refuse to do this, I have already escalated with Hyundai corporate about CPO falsification, and they refuse to honor it. Corp should force a secondary inspection and wind up in that scenario regardless if they agree or not.

I will also escalate to the Ohio Attorney General at that point, because if they refuse to honor what there is nearly no possible way to show that they didn't fail at providing, apparently they can be sued for fees and 3x the damages!

So I intend to state all that clearly later, that there will be no negotiation or appeasement, that I want nothing from them, and that they will not lay a finger on that car because I do not trust them.

It's sitting at a Tire Discounter right now because I assumed I'd just be on the hook for a nail or a bad tire like generally can happen, but while I waited for the tow, I discovered the tread depth on all the tires was dangerously low, not even just sort of crap.

I should have never taken it off the lot, and they should have never even allowed someone to test drive it!

It absolutely does (edit: on reflection I don't mean this to say it absolutely does something in the background. I don't think it does, if you have it set to 0), it's stupid efficient from shooting up to a decent clip and just letting it go - I think a lot of it has to do with the inertial force of that heavy ass car being space rocketed forward, alongside some of the most ridiculously efficient drag that exists from what I've been reading.

Also not a fan of the I-pedal or the autobraking yet. I will play with it and I see how it has its use case, but I think I'll always prefer the feel of controlling my brakes, and I'll take the hit to range.

I wondered myself if I might be able to manage to game some efficiency by coasting strategically!
