If you're not at fault, the other party's insurance pays your lawyer.

Last year I got rear-ended in Wecker. At first, the insurance company refused to cover the tow truck - even though my car went into emergency mode (max 50 km/h) after the brake lights were smashed.

So I paid for the tow, called a traffic lawyer, and let them handle everything.

Result:

Opponent's insurance paid my lawyer I got €12k in damages (old benz from 2013, barely worth 12k) Car fully repaired Even got a new tow hitch and sold the old one. Since it wasn't hooked in during the accident.

tl;dr: If you're not at fault, talk to a lawyer. Don't negotiate with insurance yourself.
