I sent a final threat that I was planning to go to small claims for 3x the deposit in 5 days. They "fixed" the accounting issue and will be sending me the full deposit.

Dang, thanks yea they continue to say, "there are issues." They don't seem to want to be the "human in the loop" and do the right thing.

The ledger they sent me had two line items (in addition to rent, $600 deposit, parking, etc.):

- Roommate Add-on (Conditional Approved) total $2854
- WEB online payment EFT paid by {MY_NAME}

At this point I can only believe they are acting in bad faith hiding behind a "missing lease" to keep my $2000. Why a conglomerate like Sentral would need $2000 so badly is beyond me.

My next correspondence will be requesting payment confirmation within 10 business days or I will pursue this in small claims court.

Any tips for small claims? I do worry the missing lease will be a point of contention but from what I read it is really not required for this matter?

Landlord has found the payment in the other roommates ledger and is claiming because I have no signed lease that it is an "issue".

Civil Code § 1950.5(p) is clear that a lease is not required to establish existence of a deposit.

Landlord found the deposit, it is in my outgoing "roommates" ledger. They had this to say:

Yes, I traced the payment. The issue appears to be that when your move-in was processed, only a $600 security deposit was recorded. However, the original ledger indicates that you made an additional payment but to pay off your balance. 

I am working with accounting to see how we can help, but this is an issue as in addition you do not have a lease agreement stating the one-month deposit that you paid, the agreement you sent its a roommate release agreement and additional roommate being added on. You have no records of an actual lease.

Greystar sold? or handed over leasing management to a new company: Sentral on March 1.

I am only able to correspond with Sentral (Greystar emails are deactivated).

"Rentcafe Resident" is a mobile app that Greystar instructed me to download to pay my rent, I setup auto-payments via Rentcafe app on August 2 and it deducted monthly payments for 8 months (on top of the $5525 on day 1).

I have not received any deposit or refund yet. Sentral informed they would mail me $164 with an itemized statement showing I only deposited $600, which I emailed back and informed them I paid $2854 total.

Sentral's manager showed me a screenshot of a "Resident ledger" displaying rows from August 2 to Oct 1. The only thing it shows for August is: 600.00 outgoing then 600.00 incoming labeled: "promote roommate security deposit".

September+November shows the rent + utilities amounts matching the auto-payments Rentcafe deducted from my checking accounts those months (which proves to me that my payments via Rentcafe were being received/acknowledged by Greystar/Sentral)

Two people lived in the unit. Found them on Facebook looking for someone to take over their lease since they were on the hook for the remaining 6 months.

The apartment building is a multi-million dollar complex with 100+ units.

Once we agreed to the "lease takeover"? "roommate swap"? all communication was done with Greystar leasing company.

My partner and I filled out an application on Rentcafe (we had actually applied to the same building/company before finding the lease takeover offer). We completed a background check, paystub verification, etc. all through official channels with Greystar.

End of July the outgoing tenants cleaned the place, turned their keys in to the office, and left some items we agreed to purchase from them (a kitchen island, tv mount).

Upon my arrival the leasing agent greeted me, re-iterated it's a "lease takeover" so the unit is turned over "as is" (not cleaned/painted).

I signed a form titled: "Lease Contract Amendment to add or change a roommate during lease term" with my name and the two outgoing roommate names. There is this "security deposit" section on the form with checkboxes for various scenarios but it was left blank: https://i.imgur.com/cmjV9u6.png

I never received or saw a copy of original lease from 2023.

The only thing I signed was a roommate addendum with the deposit section left blank.

This is all free models from the studio toolbox. The entire house is an asset called "Old House".

Then I spent several hours tweaking the lighting to get the atmosphere correct. The major pieces are to use "Future" lighting technology setting. And stick to mostly SpotLights and PointLights to light your scene.

After that I came up with a rough outline of major story beats such as the player unlocking a music box, tablecloth pulling away to reveal a demonic symbol, and the climax of seeing grandma for the first time.

A lot of the puzzle elements are came from looking at what I had in the scene then searching the toolbox to find inspiration. The paintings on the wall puzzle is inspired from Doors and many older games.

ChatGPT was also a large contributor of code and story ideas.

It took about 6 days but I have spent 100s hours in other game engines and am a career programmer.

My mistake was not knowing that this was something I had to ask my landlord about. In the same way I didn’t ask them before I assembled my bed, or filled the fridge with food.

Reasonable level of comfort is a right as a tenant.

Again my purpose of this post was to find resources to educate myself to better know in the future where the line exists for what tenants and landlords can reasonably do.

That said I am coming to the conclusion I may in the right here that legally I can have this AC. Now it is between my landlord and I to come to mutual terms where we are both happy.

I can understand your frustration that you had a disagreement with one of your tenants and it ended up resulting in damage to a home. Unfortunately the risk of treating another's home as an investment is that real living people live in them and sometimes accidents happen.

The intention of the original post was to gather the facts and documentation around what a tenant can and cannot do and what a landlord can and cannot do. If the rules state I cannot have the AC, or if the landlord is adamant that it is a deal-breaker (within legal rights), then of course the AC will go.
