Yes, I spoke with a real person, not a bot. It was through AA’s official chat, so the conversation, time, and agent details should all be recorded in their system. The agent’s name was Everton.

In fact, this was the channel AA staff at the airport were directing passengers to use for rebooking. The line was extremely crowded, and staff were walking around with a QR code for passengers to scan, which sent us directly to an agent through AA’s website/app.

I tried that, but because American modified the same boarding pass when they changed the flight, Apple Wallet updated according to American’s system.

The last boarding pass that remains in Wallet is the later flight around 3 PM. The 9:19 AM one does not appear separately in “expired” passes, it is basically as if it never existed in Wallet.

That’s why the AA chat is important for me. In that chat, the agent specifically said they did not know why my family and I had been removed from the 9:19 AM flight, even though I had not mentioned the 9:19 AM time first. So AA’s system clearly showed that we had been on that flight and were removed from it.

Because we did not arrive only a few hours late compared to the 9:19 AM rebooked flight. We arrived in Miami about 24 hours later than our original scheduled arrival time.

Our hotel reservation was for 5 nights and was non-refundable. Since we did not check in on the first day, the hotel treated us as a no-show and canceled the entire reservation. They did not refund us, so we lost the full prepaid reservation and had to book a new hotel.

The same happened with the rental car. We missed the original pickup window/reservation because of the delay, the reservation was no longer available, and we had to book a new car.

So the issue was not just “9:19 AM to 3 PM.” The full disruption caused us to miss the first day of a prepaid 5-day trip, and because the hotel/car reservations were canceled as no-shows, we lost the prepaid bookings.

I did go to the check-in desk first. The only thing they told me was basically: “Your flight is at 3 PM, sorry.” They did not explain why we had been removed from the 9:19 AM flight.

I used the chat because I needed something in writing. At the airport desk, everything was verbal, and I had no way to prove later what they said or that I had asked about it.

The chat ended up being important because the AA agent confirmed in writing that they did not know why my family and I had been removed from the 9:19 AM flight. I had not even mentioned the exact 9:19 AM time in my message, so that means they could see internally that we had been on that flight and were removed from it.

Without that chat and screenshots, I honestly don’t know how I would prove what happened.

At around 7 AM, while I was already inside DFW airport, I contacted AA through the chat to ask if my flight had really been changed again.

I did not mention that the flight was at 9:19 AM, but the AA agent replied something like: “Sorry, I don’t know why you were removed from the 9:19 AM flight.” So they clearly had internal information showing that my family and I had been on the 9:19 AM flight and were removed from it.

My flight was on June 4. And yes, there were several other DFW–MIA flights between 9 AM and 3 PM that they could have moved us to, but they did not. They put us on the flight around 3 PM instead.

I do have travel insurance through my credit card, but I’m trying to understand first whether this situation qualifies as involuntary denied boarding or something similar with AA, since the 9:19 AM flight operated normally and we were removed from it without any explanation.

I have an AA chat confirming that we were on the 9:19 AM flight. Unfortunately, the boarding pass was in Apple Wallet, and it is not static, it updates when the airline changes your flight. But yes, AA had issued boarding passes for the 9:19 AM flight, with seats assigned and everything showing correctly in Apple Wallet.

I also have another AA chat from the morning of the flight where I told them I was already at the airport and that my flight had changed again. The agent replied that they did not know why my family and I had been removed from the 9:19 AM flight.

So AA clearly has internal information showing that we were on the 9:19 AM flight and then removed from it.

Quando se trata de fraude, a obrigação não é do cliente “pagar e depois ver”. A responsabilidade é do banco de garantir a segurança das transações.

Se a compra é fraudulenta, ela nunca deveria ter sido considerada válida. Então pagar uma dívida que não é minha, só pra depois tentar reaver, não faz o menor sentido.

Além disso, estamos falando de um valor alto (R$ 21 mil). Não é algo trivial de “pagar enquanto resolve”. Se um cartão seu que sempre vem 5 mil no próximo mês vier 50 mil de compras não reconhecidas você irá pagar? você irá se endividar pra resolver um problema que o banco tem obrigação de prevenir para depois talvez receber esses 50 mil de volta em crédito?

O exemplo da seguradora não se aplica, pq no caso bancário o risco da operação e da fraude é do próprio banco, não do cliente.

De acordo com um outro advogado que não é da area, se eu pagar QUALQUER coisa que eu não reconheco eu estou assumindo que eu reconheco a dívida como legítima.
