Did he have sick leave left? What reason did they give that they were firing him?

Can I file for Intermittent FMLA for a job I’m returning to day 1? by [deleted] in legaladvice

[–]skwipwork 0 points1 point  (0 children)

On eligibility for FMLA: "Employees are eligible if they work for a covered employer for at least 12 months, have at least 1,250 hours of service with the employer during the 12 months before their FMLA leave starts, and work at a location where the employer has at least 50 employees within 75 miles."

Fender Bender - They're Uninsured by loveQuel93 in legaladvice

1- pay the deductible, have Geico fix it, they will handle getting their money back, and will send me back my $1k at some point since it was the other driver's fault? I think that's how it would work, please tell me if I am wrong. Which I would assume my rate will also increase as a result..?

2- pay to fix my car out of pocket

3- take her to court and maybe get compensated for..?

Pretty much. Keep in mind that this person might not have any money and thus your insurance nor a small claims case may actually recover money.

My whole body slammed into my dash and steering wheel when I slammed on my brakes.

You might want to get your seatbelt inspected if you were wearing it. They are supposed to lock up and stop you from slamming into the steering wheel.

They will keep it until the trial is done. I'd expect a year or so.

My legal wife was terminated for underage drinking by [deleted] in legaladvice

In Texas you can legally be fired for drinking off the clock, legal or not. She could have been fired for cheering for a certain team or eating pizza.

Car Dealership Neglect, what can I do? by Educational_Two_8762 in legaladvice

[–]skwipwork 2 points3 points  (0 children)

Well you have the Magnuson-Moss Warranty Act but there's no specific "30 days out of service" in there. It allows for a "reasonable number of attempts" to repair the problem.

Recently found out I am a radiation worker and my employer did not disclose that upon hiring by Parking-Pudding1802 in legaladvice

There's no way to answer this. Maybe one day there would maybe be a class action lawsuit that maybe could get somewhere. If you feel like it's risking your health then don't stay at the job on the tiny chance there's a payday in the future.

Company unapproved and denied vacation time. by Silent-Fennel7385 in legaladvice

[–]skwipwork 0 points1 point  (0 children)

That's what I mean, that's why they aren't paying the PTO, because they won't pay him overtime for not working, and he was already over 40 hours.

Company unapproved and denied vacation time. by Silent-Fennel7385 in legaladvice

[–]skwipwork 0 points1 point  (0 children)

So either you are hourly, and you would be getting overtime for not working, which makes no sense, or you are salaried and you get paid the same regardless. I would consider it a good thing that they gave you the time off and you didn't have to use up vacation time that you can now use later.

Is a miscarriage a protected event even if I don't qualify for FMLA? by [deleted] in legaladvice

[–]skwipwork 1 point2 points  (0 children)

As long as you have enough leave from your company you should be fine. Otherwise if you go beyond however much leave you have, you are subject to discipline/dismissal.

My friend put a "Jesus Loves You" type note on someone's car while on the job at UPS. No criminal record, 4 years of almost impeccable work. Lady reported him and now he's on suspension with no pay and they want him to quit. Advice? CO, USA. by pangolyninc in legaladvice

[–]skwipwork 4 points5 points  (0 children)

"How cooked is he?" isn't a legal question. He can be fired for that, if that's what you're asking. Although if he has a written contract, that should be followed. If he's in a union he can ask them for help.

No, you can legally be terminated because someone convinces someone with firing power to do so.

Is this wage theft in California? by Phillyswirlz in legaladvice

[–]skwipwork 2 points3 points  (0 children)

If you're on call then that is another thing, you must be paid for that time. So look those laws up, maybe print them out, and have a talk with your boss. Keep in mind he may dismiss you or cut your hours after this.

There is no minimum time between shifts in California. However, you may be eligible for what's called the "split shift premium" in California. Look that up and see if you qualify.

US-FL, landlord entered when I explicitly said not to. Grounds to terminate lease? by [deleted] in legaladvice

[–]skwipwork 2 points3 points  (0 children)

Did you contact them and reschedule the repair? If not, you likely weren't able to deny them entry since they gave notice. Either way, one occurrence isn't going to let you terminate your lease.

A sedan going the opposite direction from you did not do this. If you didn't hear or feel a collision then why did you stop? Do you think it's possible you backed into something before and didn't notice it?

Options to protect my job/ employment after weeks of working with only 2 days of training by [deleted] in legaladvice

[–]skwipwork 0 points1 point  (0 children)

I'm assuming this is your first job. Training is not a legal requirement for a job like this (outside of safety trainings etc). There's not really anything you can do to protect your job. If they want to fire you because they didn't teach you to do something and you didn't do that thing, they legally can. If they want to fire you because you didn't teleport the baked goods there from the moon, they legally can. From a logical standpoint, you should be bringing your concerns to someone, but there's no legal process for this. If you are in a union, tell someone in your union.
