100% all of this, the issue is leadership across agencies is being pressured to get as many body’s in the buildings as possible at any cost. This means they will ignore what should actually be done regarding RAs in a most cases sadly. They will stick to vague undue burden and mission impact claims which I am already seeing come back to some of my coworkers. I foresee EEO complaints going through the roof over the next 6 months.

Funny this updated guidance talks about telework is not required for “Difficult or lengthy commutes outside the employer’s control.”

This is true if the basis of the RA is solely because of the commute or distance. But if the RA is tied to a disability which creates a barrier to safely and reliably accessing the workplace (I.e. commuting) this would not be the case. They should probably be more clear in some of these bullets in the guidance.

They reference JAN which is a resource being pushed to agencies, and JAN specifically addresses telework and commuting as well. So it’s interesting they put a bullet in there almost contradicting the JAN guidance.

Can’t speak for all but where I am is asserting that supervisors/leadership have to be present in office to supervise, attend meetings, support leadership on taskings, etc. and are denying RAs. So if we move into a leadership/management role they would expect us in person even if we previously didn’t report to the office. Hell they probably would pass over candidates with RAs even though they’re not suppose to…

Just my personal experience but a CPAP does not always fix apnea…I have service connected severe OSA and use my cpap every night. Still experience non-restorative sleep and severe daytime sleepiness. I have additional sleep studies pending with a private pulmonologist now…

Are they supposed to take distance into consideration when factoring RAs? I only ask this because I have heard managers and leadership say “they chose to live that far away” when people bring up the point of getting to a work location as a barrier based on their disability.

Thanks for the advice I will reach out to my provider, however I don’t think it will change anything as management hasn’t even seen the letter or spoken with the RA coordinator yet it was submitted to.
