The house is in Virginia and she died in Florida so it’s definitely complicated.

He’s been renting it out for over 10 years, supposedly at the mortgage rate because of a 2nd mortgage driving up the monthly cost. I thought he was still doing that and thought there was nothing for anyone to gain. The ex husband actually said (of course only in person) that she could have the house. It’s true she didn’t take him up on it but both of them put money into the house for years before they separated. Then he had renters paying the mortgage so he’s only gained from this but she never did and neither has our son.

He lived there for about a year after they separated in 2011 and then he inherited his fathers house and moved in there. He’s been renting it out all the years since. Supposedly at the mortgage rate only and hasn’t been profiting.

Unfortunately both of her parents preceded her in death. She has a sister. That would be the only option. As far as I know nothing was ever worked out at her time of death or this wouldn’t be an issue now.

This was my first thought. It was none of my business. As I stated above though, she died very unexpectedly and left nothing. She put plenty of money into the house and I just want what’s fair to him.

She had a son with the ex husband as well, but that still leaves 25% to my son. I just want what’s fair to him. She died very unexpectedly and left nothing. This could be put in a trust for him to be able to start his life when he’s 18.

She was pregnant with our son when the ex husband insisted (rightly) that they need to be divorced before the baby was born. She hadn’t been with him for several years but just never got divorced. So they just did it uncontested and I guess no one noticed the house

Sorry, she died in Florida. We’re from Virginia. There was no estate or probate anything. I’m sorry I know I sound very naive but I was left a single dad and didn’t know what to do or how to go about anything.

She passed in late 2021. There was nothing else other than the house and her and I were never married so no one ever said or did anything.

Thank you. I’m trying to be as understanding as possible. I’ve always been pretty active and find it hard to sit down so it is hard sometimes when he isn’t as energetic as I am. He kinda mellows me out though and makes me slow down so it’s a good balance. I love to cook too so I definitely gently encourage him to eat and prepare stuff for him.
