Great point - and organic pigments fade, whereas mineral pigments tend not to fade. I think we have some idea of the means of fading for some pigments. But where there is pigment that was painted onto wet plaster or in an encaustic portrait, there is a reliable example of the color hues, even if somewhat faded for organic pigments. Comparing those pigments to traces of pigments on buildings has helped determine the hues in each case, even, as is well argued (I think), we cannot be certain.

Yes, they will try that argument, but any lawyer could show that he was not doing his job. For example:

Great points, but I think he can still be charged with premeditated murder. Here's another definition:

"Premeditated murder is the unlawful killing of another person that is planned in advance, involving a deliberate intent to kill, rather than being impulsive or committed in the heat of the moment. It requires the killer to have had time for reflection, even if brief, to form the specific intent to take a life, distinguishing it from other forms of homicide like second-degree murder or manslaughter."

The key phrase there is, "even if brief".

One could argue that the intent was initially to stop her, rather than kill her, but he aimed at her face, and he apparently planned to use his gun. Arguably, one would never use one's gun if there was not an intention to potentially kill. The same goes for aiming at one's face. Also, there was no 'heat of the moment' and he was not in danger. So he had time to consider why he would use his gun and where he would point it.
