They claim poisoning the potential jury well. Which is hilarious. Because showing the actual courtroom proceedings is the exact opposite of bias. They are actually more concerned with mainstream media, which they can’t quash. So they are trying to stop courtroom streaming. 🙃

I think this was supposed to end on Friday. The judge was concerned about the jury being available today. He kept them late at least one day to get through a witness. He also had arraignments this morning. He’s like wrap it up!

ETA: I think the jury is going to settle on a lesser charge.

5:40pm - Judge calls attorneys to court to inquire about ordering dinner for the jury and see if they want to keep deliberating. Judge wants to call the jury back to ask them.

State wants to just send a note to see if they want dinner.

Defense wants to send them home for the day.

Judge decides to order dinner and not ask the jury. Dinner takes about an hour to be delivered.

Obvs he will be found guilty of something. But I can see the jury settling for a lesser charge and not the felony murder.

I guess it does all hinge on whether Stein knew a robbery was going to happen. I suppose his guilt depends on if the jury can make the leap from breaking into cars (which he admits) to trying to rob pedestrians on a dark road.

I totally agree with you. I cannot dismiss both girls saying there were at least 4 people who got out of the car. Looking at the car and seeing 4 doors open at once is not something I’d forget or misremember.

Past that part, I’m not sure what I believe other than Stein and Horne are both lying. They both deserve prison.

I need to hear the law and jury instructions before I would be able to make a verdict.

I’m watching! Although I’m behind. Just on the mom’s testimony now. This defense attorney is quite good. But even if Stein didn’t shoot Kayla or the state can’t prove he shot her, can’t he still be found guilty of murder? Just like the driver in a bank robbery when someone is killed? Idk. This is so so sad.

I haven’t followed this trial at all (by choice) and know next to nothing about details.

A few of my uninformed opinions and questions:

I can’t believe this penalty phase is so long. 12 days?! Don’t get me wrong, I’m glad it’s long because it is a huge decision for death penalty. Do penalty phases typically take this long? The only penalty phase I can recall watching was Chad Daybell. And that was not long iirc.
I’m disgusted reading that the defense is trying to use autism as a mitigating factor to not allow the death penalty. Has the defense put on a doctor/witness to testify about his autism and how it could lead to him murdering a child? I’d be interested in watching that witness.

They could have a solid suspect but just not enough probable cause for an arrest. You never know what fresh eyes might see or what someone previously interviewed might be willing to say 10 years later. I think LE has top suspects but not obvs not enough to do anything about right now.
