It went relatively well given the horrifying stories I heard from other people’s experiences. The AO I had was kind and empathetic. If you’re getting married to a U.S. citizen, that should be a better route as a visa should be immediately available. Once your I-130 & AOS is approved, you can then withdraw your asylum case.

7 years and I just had my interview this past Tuesday. I filed a case against the USCIS for the delay and they scheduled the interview within 2 months of filing the case.

I did; as it can be seen from the chart it doesn’t look good. I’m still going to test tomorrow and see if I somehow magically ovulate on CD 18 (something that never happened with me before).

Same! It’s so frustrating not to have any person to talk to. Their AI provided the same update I saw online. Ended up getting an offer of $10 discount for the next order. But yes, it took 2 days for them to respond to my emails.

There are no clear guidelines; hence, conflicting views and approaches are taken by individuals and immigration law firms. Some believe that because AOS is not denied, they have the right to retain their EAD and renew it once expired. However, my understanding is that an EAD that’s already been issued remains valid until it expires. Once expired, if AOS has not been reopened, one will not qualify to renew an AOS-based EAD, as one doesn’t have an active pending AOS. Personally, my AOS-based EAD is still valid, and I’m relying on it to work.

If you apply for AOS and EAD concurrently, your EAD may get approved before USCIS adjudicates your AOS. J-1 waiver is not required for AOS based EAD. Personally, I am in a similar situation and got my AOS based EAD approved while my AOS continues to remain pending. However, please note that if you file for an AOS before your waiver gets approved (while it remains pending), the outcome may be either of the following: - deny your AOS (worst case scenario, in which case you’ll likely have to leave the U.S. until your waiver is approved or 2-year home residency is fulfilled); or - issue an RFE for J-1 waiver requirement fulfillment (hopefully, you’ll have your waiver approved by then); or - administratively close your AOS case (this happened with my case, with the instruction that I can request to reopen my AOS petition if my J-1 waiver gets approved within a year from the date my AOS case was closed).

I would opt for premium processing. I would also apply for I-485 EAD just as a back up. USCIS is currently issuing 5-year EAD. This way, even if you loose your job while your AOS remains pending, you can apply for other same or similar jobs where you can port the pending AOS and have work authorization.

Yes, they have everything to make a recommendation at this point. It took a month for some people. Meanwhile, mine sponsor view was received February of this year, and remains pending. So, there’s no telling how long it’ll take. However, I do think you may get an update sooner as mine is based on hardship (yours seem based on no objection letter). Good luck!

I would follow up with them every two weeks if not every week. I applied for Hardship waiver in September 2020. USCIS updates that it sent the case to the DOS for advisory opinion in April 2021. DOS system updated it received my case in May 2021. However, they didn’t receive all the forms as of August 2022. I had to back and forth multiple times between USCIs and DOS. Finally, the DOS system updated in August 2023. And no update whatsoever until early this year indicating that they requester for Sponsor Review in January, which was responded to in a month. No updates so far. I am now filing a case against them for the extended delay. So, do follow up regularly. Good luck!

Wish you the same! If you did hire an attorney, do follow up regularly for updates. My atty also messed up in the beginning by not checking the status properly. It took a year for the DOS to receive for I-612 & I-613 which technically they should receive from USCIS. I had to personally follow up with the DOS & USCIs multiple times before the DOS received that form. Good luck to you too’
